Future Development Area shall have the meaning set forth in the Recitals of this Agreement.

Future Development Area means and refer to the portion of the Real Estate that is to be set aside for future development after annexation into a city, as identified in a Certificate of Survey.

• Any parcel of Campus property that ceases to be subject to either the ▇▇▇ Development Agreement or an ▇▇▇ Ground Lease shall cease to be treated hereunder as part of the Initial Development Area, and shall thereafter be treated as being within the Future Development Area.

• The parties acknowledge that (a) there is a hotel currently being operated by Kimpton Hotel & Restaurant Group, LLC or an affiliate (“Kimpton”) in the Hotel Unit (as defined in the Master Declaration), and (b) there is undeveloped land comprising the Future Development Area Unit that Seller or its assigns may develop in the future.

• The Trustee or its nominee may apply to the Minister for approval of the Future Development Area Scheme after the Coordinator-General has completed a report evaluating the environmental impact statement under Part 4— Environmental Coordination of the State Development and Public Works Organisation ▇▇▇ ▇▇▇▇ and given a copy of the report to the Trustee or its nominee.

• As such, the City and the Owners agree that any land use application for future subdivision within the Future Development Area identified in Exhibit C will provide a mix of housing types with at least ten twenty percent (1020%) of the gross number of housing units consisting of duplexes or accessory dwelling units (ADUs).

• The Future Development Area is proposed to be the subject of Development for an Ocean Terminal and residential and related Uses as specified in the Future Development Area Scheme to be approved by the Minister.
