Commencement of Development definition

Commencement of Development means the date on which any material operation (as defined in Section 56(4) of the Act) forming part of the Development is begun other than (for the purposes of this Undertaking and for no other purpose) operations consisting of site clearance, demolition work, archaeological investigations, investigations for the purpose of assessing ground conditions, remedial work in respect of any contamination or other adverse ground conditions, diversion and laying of services, erection of any temporary means of enclosure, the temporary display of site notices or advertisements and “Commence Development” and similar expressions shall be construed accordingly

Commencement of Development means the date on which any material operation (as defined in Section 56(4) of the Act) forming part of the Development begins to be carried out other than (for the purposes of this Deed and for no other purpose) operations consisting of site clearance, demolition work, archaeological investigations, investigations for the purpose of assessing ground conditions, remedial work in respect of any contamination or other adverse ground conditions, diversion and laying of services, erection of any temporary means of enclosure, the temporary display of site notices or advertisements and “Commence Development” shall be construed accordingly.

Examples of Commencement of Development in a sentence

• This Deed shall cease to have effect (insofar only as it has not already been complied with) if the Planning Permission shall be quashed, revoked or otherwise withdrawn or (without the consent of the Owner) it is modified by any statutory procedure or expires prior to the Commencement of Development.

• The Property Owner must secure a Building Permit or Commencement of Development to vest this Variance.

• The safeguarding of a 1.1ha site for a Primary School and obligations securing the transfer of said site to Devon County Council if required by the County Council within an agreed time period running from Commencement of Development and expiring 5 years after any Commencement on the western development parcel.

• For the avoidance of doubt this Deed is entered into on the understanding that in the event of the Outline Planning Permission being quashed as a result of any legal proceedings or pursuant to Section 97 of the Act or expires before the Commencement of Development or for any other reason then this Deed shall absolutely determine and shall become null and void.

• The bond or other financial provision will be subject to a five yearly review which shall include a monitoring statement of extracted and reinstated levels, paid for by the applicant and /or the operator of the quarry, from the Commencement of Development, to be conducted by a competent independent professional (Compliance Monitoring Officer) who has relevant experience within the quarrying sector and provided to the Company, the landowners (if different), and the Planning Authority.

More Definitions of Commencement of Development

Commencement of Development means the earliest date on which any material operation comprised in or carried out for the purposes of the Authorised Development begins to be carried out such material operation to be interpreted in accordance with Section 155 of the 2008 Act save that for the purposes of this Agreement the following operations do not constitute a "material operation": site investigations or surveys; display of notices or advertisements; erection of fences; investigations for assessing ground conditions; or the erection of a temporary construction compounds;

Commencement of Development means the date on which Development shall be taken as begun in accordance with section 27 of the Town and Country Planning (Scotland) Act 1997;

Commencement of Development. – means the date on which any material operation (as defined in Section 56(4) of the Town and Country Planning Act 1990) forming part of the Development begins to be carried out other than operations consisting of site investigation surveys and decontamination works, the erection of any site fencing or other site security, the laying or diversion of any services or other works in respect of or in relation to any statutory undertaker’s equipment or concerns, the carrying out of any archaeological, environmental or ecological works and any works matters and operations to enable any of the foregoing to take place.

Commencement of Development means the date on which a material operation as defined in Section 56(4) of the 1990 Act shall be commenced in respect of the development provided that it shall not include operations in connection with site investigation demolition site clearance archaeological work and the erection of hoarding or other means of enclosure for the purpose of securing the site and the word “Commence” and “Commenced” in relation to the Development shall be construed accordingly.

Commencement of Development. Means (for the Purposes of this Deed and for no other purpose) the date on which any material operation (as defined in Section 56(4) of the Planning Act) begins to be carried out on any part of the Land PROVIDED ALWAYS THAT the following operations shall not be treated as material operations for the purposes of this Deed only: operations consisting of archaeological investigations, investigations for the purpose of assessing ground conditions, remedial work in respect of any contamination or other adverse ground conditions, the temporary display of site notices or advertisements and “Commence Development” shall be construed accordingly

Commencement of Development means (for the Purposes of this Agreement and for no other purpose) the date on which any material operation (as defined in Section 56(4) of the Planning Act) begins to be carried out on any part of the Application Site PROVIDED ALWAYS THAT the following operations shall not be treated as material operations for the purposes of this Agreement:
