ASSUMPTION OF THE RISKS. I hereby freely assume the inherent risks as well as any other risks not listed that are part of these Activities, and any harm, injury, illness, or loss that may occur to me or my property as a result of my participation in the Activities or during any transportation to or from the Activities—including any injury, illness, or loss caused by the negligence of REI, its employees, agents and officers, its contractors, and other Activities participants. I also understand that any equipment that I provide or may borrow or rent from REI or any other provider I use at my own risk and that any such equipment is provided without any warranty about its condition or suitability.

ASSUMPTION OF THE RISKS. Bay swimming and is an inherently dangerous activity. Bay swimmers have been seriously injured and even killed. For example, a fishing boat once hit and killed a swimmer. Other objects in the water have injured swimmers. Sea lions and other animals have attacked swimmers. There may be health hazards arising from swimming in Bay waters that have been contaminated by pollutants. Bay currents, often powerful enough to overwhelm even an Olympic swimmer, are unpredictable and can sweep swimmers far off their course. Bay waters are cold. Temperatures typically range from 45 to 63 degrees (Fahrenheit). Swift currents and cold water have caused drownings, heart attacks, and hypothermia. These dangers are just some of the hazards associated with Bay swimming. THE SIGNATORY UNDERSTANDS AND ASSUMES ALL THE RISKS ASSOCIATED WITH SWIMMING IN THE BAY. WAIVER AND RELEASE: The SERC was founded in 1873, and is a non-profit, low-cost club. The facilities are more historic than "state-of-the-art," Most maintenance of and support for SERC facilities and events are performed by SERC members on a volunteer basis and may therefore be less than perfect. I agree that the privileges of associating with the SERC and engaging in SERC activities are adequate compensation and consideration for this waiver and release. ACCORDINGLY ON BEHALF OF MYSELF AND MY HEIRS, ASSIGNEES, PERSONAL REPRESENTATIVES AND NEXT OF KIN, I HEREBY RELEASE THE SOUTH END ROWING CLUB, ITS OFFICERS, MEMBERS, AGENTS AND EMPLOYEES FROM ANY AND ALL LIABILITY RESULTING FROM INJURY, DISABILITY, DEATH, LOSS OR DAMAGE TO ME OR MY PROPERTY, AS A RESULT OF MY PARTICIPATION IN THE SWIM EVEN IF CAUSED BY THE NEGLIGENCE OR INTENTIONAL MISCONDUCT OF THE RACE DIRECTOR, SWIMMING COMISSIONER, THE SWIMMERS, PILOTS AND OTHER PARTICIPANTS IN THE SWIM OR OF THE SERC OR ITS OFFICERS AND MEMBERS. I agree that my participation or my Camper’s participation in the Activities are entirely voluntary and I, or I on my Camper’s behalf, freely assume the above-mentioned risks and any harm, injury or loss that may occur as a result of my or my Camper’s participation in the Activities.

I FURTHER AGREE ON BEHALF OF MYSELF AND MY MINOR CHILD(REN)/XXXX(S) THAT, EVEN IF FFF USES REASONABLE CARE IN PROVIDING ACCESS TO THESE ACTIVITIES, THERE IS A CHANCE I OR MY MINOR CHILD(REN)/XXXX(S) OR ANY CHILD ON WHOSE BEHALF I SIGN THIS AGREEMENT MAY BE SERIOUSLY INJURED OR KILLED BY PARTICIPATING IN THE ACTIVITIES BECAUSE THERE ARE DANGERS INHERENT IN THE ACTIVITIES. BY SIGNING THIS AGREEMENT, I AM GIVING UP MY MINOR CHILD(REN)’S/XXXX’(S’) RIGHT, THE RIGHT OF ANY MINOR ON WHOSE BEHALF I SIGN THIS AGREMEENT, AND MY OWN RIGHT TO RECOVER FROM FFF IN A LAWSUIT FOR ANY DAMAGES, INCLUDING PERSONAL INJURY, BODILY INJURY, OR DEATH TO ME OR MY CHILD(REN)/XXXX(S), OR MINORS ON WHOSE BEHALF I SIGN THIS AGREEMENT, OR ANY PROPERTY DAMAGE, THAT RESULTS FROM THESE RISKS. I HAVE THE RIGHT TO REFUSE TO SIGN THIS FORM, AND FFF HAS THE RIGHT TO REFUSE TO LET ME OR MY CHILD(REN)/XXXX(S)/MINORS PARTICIPATE IF I DO NOT SIGN THIS FORM. I acknowledge that I have read the rules (the “FFF Rules”) governing my and/or my child(ren)’s participation in any activities and that I have explained the FFF Rules to any child(ren) listed herein. I understand that the FFF Rules have been implemented for the safety of all guests, including myself any children. I acknowledge that failure to follow the rules could result in the expulsion of myself and/or my child(ren) from FFF.

My and my CHILD's participation in the ACTIVITIES at GP is purely voluntary, and I and my CHILD elect to participate in spite of the RISKS. ASSUMPTION OF THE RISKS. I understand that the description of the risks involved in NatureBridge activities set forth above is not complete, and that other risks may result in property loss, personal injury, or death. On behalf of myself and my Minor Participant (if applicable), I agree to assume, to the fullest extent permitted by law, all risks of participation in the Program, whether known or unknown, and whether or not such risks are described above.
