Trimming of Trees and Shrubbery. The Grantee shall have the authority to trim trees or other natural growth overhanging any of its Cable System in the Franchise Area so as to prevent contact with the Grantee’s wires, cables, or other equipment. All such trimming shall be done at the Grantee’s sole cost and expense. The Grantee shall be responsible for any damage caused by such trimming.

The foregoing notwithstanding, any tree trimming by Franchisee must comply with any separately negotiated pole attachment agreement in effect between the Town and the Franchisee.

Trimming of Trees and Shrubbery. The Grantee shall have the authority to trim trees or other natural growth overhanging any of its system in the Service Area (meaning the utility or other easement area use by City) so as to prevent branches from coming in contact with the Grantee’s wires, cables, or other equipment. Grantee shall follow such local laws as exist currently or as may be adopted or amended during the term of this Franchise relating to tree trimming. The Grantee shall reasonably compensate the City or property owner for any damages caused by such trimming, or shall, in its sole discretion and at its own cost and expense, reasonably replace all trees or shrubs damaged, with similar size, shape, or otherwise City approved, as a result of any construction or maintenance of the system undertaken by Grantee. Such replacement shall satisfy any and all obligations Grantee may have to the City or property owner for any problems involving trees, fauna or other natural resources pursuant to the terms of this section.
