Submittal of Request. Either Party must submit its request for a special rate review in a form and manner specified by County, together with required cost and operational data. County, acting reasonably, will review the request and determine the amount owed, if any, to Contractor and the time period to be covered by special circumstances.

Submittal of Request. If the Contractor is requesting a special review of Contractor’s Compensation, the Contractor must submit its request for a special review, and supporting cost and operational data, in a form and manner specified by the City. The financial and operational data that City is likely to require include, but are not limited to, audited financial statements, detailed customer account information, route data, tonnage reports, and other transactional data. If City is requesting a special compensation review, the City will notify the Contractor and the Contractor shall, within thirty (30) days, submit cost and operational data as requested by the City, in a form and manner specified by the City.

The CCCSWA may waive the eight‐ (8‐) 3281 month submittal requirement if the reason for the special review is a Change in Law that will 3282 become effective in less than an eight (8) month period. 3283 If CCCSWA is requesting a special review of Maximum Rates, the CCCSWA shall notify the 3284 Contractor at least nine (9) months before the proposed effective date of any Maximum Rate 3285 adjustment. Upon such notification, Contractor shall, within thirty (30) calendar daysDays, submit 3286 reasonable cost and operational data as requested by the CCCSWA, in a form and manner 3287 specified by the CCCSWA. 3288 A request for special Special Rate Adjustment review shall include a proposal on whether the 3289 Maximum Rate adjustment resulting from the special review shall be an adjustment in addition to 3290 or in lieu of the annual adjustment to Maximum Rates to be performed in accordance with Section 3291 10.2.C above.

Upon such notification, Contractor shall, 2811 within thirty (60) calendar days, submit reasonable cost and operational data and 2812 proposed adjustment to Contractor’s Compensation as requested by the Agency, in a 2813 form and manner specified by the Agency. 2814 A request for special review of Contractor’s Compensation shall include a proposal on 2815 whether the Contractor’s Compensation adjustment resulting from the special review 2816 shall be an adjustment in addition to or in lieu of the annual adjustment of Contractor’s 2817 Compensation to be performed in accordance with Section 11.02 above.

Upon such notification, Contractor shall, within thirty (30) Days, submit reasonable cost, operational, and material sales revenue data as requested by the City, in a form and manner specified by the City.
