Recognition of Duties. The Employee agrees to be a faithful and loyal employee of the Board of Regents. The Employee agrees to devote Employee’s best efforts to the performance of all duties of president as outlined by the Board of Regents and to give proper time and attention to furthering Employee’s responsibilities as president and to comply with all rules, regulations, policies, and decisions established or issued by the Board of Regents, the NSHE and the Institution. The Employee agrees that, notwithstanding any provision of Article 5.8 herein, during the Term, Employee shall not engage, directly or indirectly, in any business or investments that would materially detract from or interfere in any way with Employee’s ability to apply best efforts to the performance of all duties hereunder.
Recognition of Duties. Subject to the other provisions of this Agreement, Associate Head Coach shall devote his/her full time, skill, and attention to the performance of his/her duties as the Associate Head [Men’s/Women’s] [delete if sport is football] __________ Coach at the University. He/She will report directly to and act and perform to the reasonable satisfaction of the Head Coach for [Men’s/Women’s] [delete if sport is football] __________, who will determine Associate Head Coach’s duties and responsibilities. Associate Head Coach’s job duties and responsibilities may be reviewed and revised from time to time by the Head Coach, provided such duties are reasonable and consistent with duties typical of an intercollegiate assistant [men’s/women’s] [delete if sport is football] __________ coach who coaches at an NCAA Division ___ __________ program. Within 45 days following the conclusion of each season, Head Coach shall evaluate Associate Head Coach’s performance.

He/She will report directly to and act and perform to the reasonable satisfaction of the Athletics Director, who will determine Head Coach’s duties and responsibilities. Head Coach’s job duties and responsibilities may be reviewed and revised from time to time by the Athletics Director, provided such duties are reasonable and consistent with duties typical of an intercollegiate Head [men’s/women’s] [delete if sport is football] __________ Coach who coaches at an NCAA Division ___ __________ program. Within 45 days following the conclusion of each season, Athletics Director shall evaluate Head Coach’s performance.

Subject to the other provisions of this Agreement, the Assistant Athletics Director shall devote his/her best efforts full-time to leadership, supervision, and promotion of the University’s athletic programs. Assistant Athletics Director will report directly to and act and perform to the reasonable satisfaction of the Athletics Director, who will determine Assistant Athletics Director’s duties and responsibilities. The Athletics Director shall evaluate the Assistant Athletics Director's performance at least on an annual basis.
Recognition of Duties. Subject to the other provisions of this Agreement, the Athletics Director shall devote his/her best efforts full-time to leadership, supervision, and promotion of the University’s athletic programs. Athletics Director will report directly to and act and perform to the reasonable satisfaction of the President of the University (“President”), who will determine Athletics Director’s duties and responsibilities. The Athletics Director shall confer with the President on a regular basis as determined by the President and on significant matters as necessary or appropriate. The President shall evaluate the Athletics Director’s performance at least on an annual basis.

Subject to the other provisions of this Agreement and the Professional Services and License Agreement between University and LLC, Coach shall devote his full time, skill, and attention to the performance of his duties as the Head Football Coach at the University. He will report directly to and act and perform to the reasonable satisfaction of the Men’s Athletics Director, who will determine Coach’s duties and responsibilities.

The Employee agrees to devote Employee’s best efforts full time to the performance of all duties for the University, to give proper time and attention to furthering Employee’s responsibilities to the University and to comply with all rules, regulations, policies, and decisions established or issued by NSHE, the University, the NCAA, and the Mountain West Conference (the “Conference”) or any successor conference, and to comply with all rules, regulations, policies, and decisions established or issued by the athletic department of the University (the “Athletic Department”). The Employee agrees that, notwithstanding any provision of Article 5.8 herein, during the Term, Employee will not engage, directly or indirectly, in any business or investments that would materially detract from or interfere with Employee’s ability to apply best efforts to the performance of all duties hereunder. Subject to the provisions of Article 5.8, the Employee also agrees not to knowingly usurp any corporate or competitive opportunities of the University.

Athletic Director will report directly to and act and perform to the reasonable satisfaction of the __________ [insert title of individual to whom Athletic Director reports], who will determine Athletic Director’s duties and responsibilities. The Parties agree to meet and formally discuss all aspects of the operation of the Program within 45 days following the conclusion of each season.
