PERFORMANCE AND GUARANTEE. 9.1 All necessary tests shall be carried out at hospital by the vendor to demonstrate whether performance of the instrument conforms to the relevant standards and specifications and meets the functional requirement indicated in the specification.
PERFORMANCE AND GUARANTEE o The Seller guarantees quality and accuracy in all work that is carried out. Any deviations to this will result in an amendment and correction at no additional cost to the customer provided that sufficient material is left over for the samples to be re- machined according to specification. Should there not be sufficient material, the purchaser must resupply the sample and the purchaser is liable for this cost The above mentioned warrantee shall not be applicable if any one or more of the following events occur: o If the purchaser fails to report the error to the seller in writing within 14 days of the specific delivery o If the purchaser fails to fulfill any of their obligations with respect to the contract of sale contract o If the purchaser fails to grant the Seller adequate time and opportunity to carry out all work which the seller may deem necessary o If the error is due to the purchaser not supplying the correct or all the necessary information Cancellation: o Notwithstanding anything herein before contained, should the Purchaser breach any of the terms and conditions of the contract (whether material or not) and fail to remedy such breach within 10 days of dispatch of written notice requiring him so to do, or should a Provisional Order of Sequestration or Liquidation or should Default Judgment be obtained against the Purchaser, the Seller shall have the right, notwithstanding any previous waiver, to claim payment of the full balance then owing by the Purchaser or to cancel the contract, retain all monies paid, take repossession of all goods delivered without prejudice to any claim for damages o When deposits are paid, cancellation 30 days (or one calendar month) prior to the commencement of the project, the client will be entitled to a refund of the deposit (provided that no work has been carried out). In the event that work has been carried out at the client’s request, the client will be liable for the pro-rate amount. o When deposits are paid, cancellation 14 days (2 weeks) prior to the commencement of the project, the client will be entitled to a refund of the 50% deposit amount (provided that no work has been carried out). PERFORMANCE AND GUARANTEE. Security in an amount equal to the sum of (1) 100% of the estimated cost of construction of the Landscaping Work and (2) $3,062,083, which is 100% of the estimated Civil/Earth Work costs to be reimbursed to District under Section 14.a. Such security shall consist of a corporate surety bond, in a form acceptable to District, issued by a surety admitted in California and naming District as co-obligee on the bond. With this security, American Rivers guarantees performance under this Agreement and acceptance against any defective materials or any unsatisfactory performance.
PERFORMANCE AND GUARANTEE. 23.01. Landlord shall deliver to Tenant, within fifteen days after the date hereof, at the sole cost of Landlord: (i) a performance bond in an amount, form and substance, which encompasses the construction of the Premises and the completion of the road, curb and gutter improvements in the park and to the southwest entry point into the Stiva Airport Industrial Park as per EXHIBITS A AND D, to insure Landlord's obligation to construct and perform under this Agreement, and (ii) a bond in the amount of US$50,000.00 dollars to guarantee that Landlord will make any repairs or replacements to the Premises or any part thereof needed due to any hidden or latent defect. The terms and conditions of such bonds are described in EXHIBITS K AND K-BIS attached hereto and forming a part hereof.
PERFORMANCE AND GUARANTEE. 12.1 All Parties agree, Longde Wenchuang establishes or delegates, according to the practice of common fund, related special fund to perform this Agreement, Longde Wenchuang is entitle to transfer all its rights and obligations hereunder to the said fund, the said transfer will be effective by notifying to all Parties of this Agreement.

The performance of the items supplied in terms of this specification, as defined by the order, shall be warranted by the Vendor and, if specified, be tested in accordance therewith. The vendor shall not be specifically required to conduct a performance test on site. A minimum guarantee period of 12 months is required.
