Performance Requirements definition

Performance Requirements. The ordering entity reserves the right to inspect and verify that all deliveries are in accordance with specifications, both at the point of delivery and at the point of use. For orders that specify an “authorized partyto receive and inspect deliveries and/or installations, acceptance and inspection procedures must be performed by the” authorized party” to be considered and accepted by the ordering entity. Products inspected at the time of use are subject to refusal and return requirements for issues of quality such as defects in manufacturing and/or workmanship. Products will not be considered accepted by the ordering entity until the installation is complete for the applicable products.
Performance Requirements means the provisions of the Building Code which set out the technical requirements in accordance with which buildings must be built;
Performance Requirements means the performance measure(s) set forth in Exhibit A.

Examples of Performance Requirements in a sentence

  • Throughout the term of the contract, any deviations from the approved Minimum Performance Requirements and the implemented project shall be approved in writing by the NYSERDA Project Manager.

  • For all Renewal Work upon its first installation in the Project and before such Renewal Work shall be considered complete: (a) DB Contractor shall comply with the Performance Requirements; and (b) DB Contractor shall not be entitled to a Defect Remedy Period for any Defects identified through TxDOT inspections of such Renewal Work.

  • Submission of deliverables to NYSERDA electronically (by email or via Salesforce) constitutes certification of the veracity of information contained therein, and compliance with Minimum Performance Requirements as identified in this Agreement.

  • Additional coordination requirements with railroads are described in Section 9.7.9. DB Contractor shall perform all necessary Maintenance Services to keep the Maintained Elements in compliance with the Performance Requirements.

  • Developer shall diligently perform Renewal Work as and when necessary to maintain compliance with such Performance Requirements.


More Definitions of Performance Requirements

Performance Requirements means (i) with respect to a Segment or the System, the applicable System Performance Requirements set forth or to be developed by mutual agreement pursuant to the System Performance and Availability section of the Technical Volume, (ii) with respect to any System Upgrade, the applicable System Performance Requirements set forth in or to be developed by mutual agreement pursuant to the Technical Volume or (iii) in each case, such other Segment, System or System Upgrade performance levels as mutually agreed by the Parties.
Performance Requirements means, for each Element of the Project during the Operating Period, the requirements set forth in Attachment 19-1 to the Technical Provisions in the Column headed “Performance Requirement”.
Performance Requirements means, for each Maintained Element in connection with the Maintenance Services, the requirements set forth in the Performance and Measurement Table. A Performance Requirement is achieved provided DB Contractor repairs each Defect within the specified Defect Repair Period.
Performance Requirements mean the performance requirements as set forth on Exhibit A of this Agreement. Notwithstanding this Section 1 and, unless otherwise specified in the Agreement, capitalized terms shall have the meanings attributed to them under the Plan.
Performance Requirements shall have the meaning set forth in Section 4.5.
Performance Requirements is defined in Section 4.1.1.
Performance Requirements means the performance requirements set forth on the Schedule A hereto.
