Pay While Awaiting Workplace Safety and Insurance. Board (WSIB) Ruling - A member who is injured on duty and is unable to work as a result of such injury shall receive payment in accordance with the Sick Leave Plan while the member is off work, until such time as a ruling has been made by the WSIB upon the member's claim. When the sick leave credits have been exhausted, the member will have the option to have unused vacation and/or lieu time deducted. If a WSIB claim is subsequently approved the employer will apply the member's entitlement from the WSIB to the member's sick leave credits to replenish those credits on a pro-rata basis. Such payment shall continue until sick leave credits are exhausted, at which time the member will have the option to have unused vacation and/or lieu time deducted and replenished on the same pro rata basis as sick leave credits. Where sick leave credits, vacation and lieu time are depleted, the member shall receive benefits directly from the Workplace Safety and Insurance Board. Under no circumstances shall a member receive more pay while off work on WSIB than while at work.
