Workplace Safety & Insurance Board. (a) A Nurse who is injured while at work and as a result of such injury is certified by a medical doctor as unfit to complete the working day, shall receive pay at the regular rate for time lost on the day that such injury is sustained and no deduction will be made from sick leave credits with respect to that particular working day.

Workplace Safety & Insurance Board. 36.01 Where an employee is absent due to illness or injury which is compensable by Workplace Safety & Insurance Board, the following shall apply:

Workplace Safety & Insurance Board. 19:01 If an employee is injured in the course of performing work duties assigned by the Company and as a result of such injury is in receipt of payment by the Workplace Safety Insurance Board (WSIB) for time lost, the Company shall pay the difference between the amount received by the employee from the WSIB for lost basic wages and the amount the employee would have received for such employee’s basic wage had the employee not been injured. Under no circumstances shall the Company continue the make-up of the difference beyond three (3) calendar months from the day the employee became entitled to WSIB payment. Basic pay is defined as the amount received by an employee for eight (8) hours work per day or forty (40) hours per week or, seven and one-half (7½) hours per day or thirty-seven and one-half (37½) hours per week, as determined by the work schedule at the time of the injury, excluding shift premiums, overtime and standby compensation. This Article does not apply to probationary employees. It is understood that any payment by the Company which exceeds an amount greater than the employee’s basic wage when such an amount is combined with the employee’s WSIB payment, then such excess payment shall be refunded to the Company.
