Notice of Settlement. Each Program Participant and her counsel shall provide the Claims Administrator and Organon’s counsel a copy of a letter or other communication (i) notifying each Governmental Payor identified pursuant to Section 9.01(B)(1) that a claim related to the Program Participant’s alleged use of NuvaRing has settled; and (ii) requesting a written response indicating whether each Governmental Payor holds any interest, including Liens and subrogation interests, related in any way to such Program Participant’s alleged use of NuvaRing and the claimed amount of any such interest.
Notice of Settlement. 5. Xxxxxxxx Xxxxxx Consultants, LLC shall serve as Settlement Administrator. The complete responsibilities of the Settlement Administrator are set forth in the Settlement Agreement, including that the Settlement Administrator will obtain addresses for Class Members from a qualified third-party, such as IHS/X.X. Xxxx, that maintains databases related to the automobile industry and which specializes in obtaining such information from, inter alia, the Departments of Motor Vehicle of all fifty (50) States in the United States and its territories, including Puerto Rico.
Notice of Settlement. Each Program Participant and her counsel agree to provide BHCP’s attorneys, either directly or through the Lien Resolution Firm, a copy of a letter or other communication notifying each Governmental Payor identified pursuant to Section 8.01(B)(1) that: (i) a claim related to the Program Participant’s alleged use of DCOCs has settled; and (ii) requesting a written response indicating whether each Governmental Payor holds any interest, including liens and subrogation interests, related in any way to such Program Participant’s alleged use of DCOCs and the claimed amount of any such interest.
Notice of Settlement. Approval means the form of notice, agreed to by the Parties, or such other form as may be approved by the Court, which informs the Class of the approval of this Settlement Agreement, and how to make a claim.

No later than sixty (60) business days after the execution of this Settlement Agreement by Xxxxxxxxx Farms, Interim Co-Lead Counsel and Xxxxxxxxx Farms’ Counsel shall jointly file with the Court a notice of settlement and stipulation for suspension of all proceedings by Class Plaintiffs against Xxxxxxxxx Farms in the Action pending approval of the Settlement Agreement.

Please also be advised that the Court-appointed Lead Plaintiff, Xxxxxxx Xxxxxxxx (“Lead Plaintiff”), on behalf of himself and the Settlement Class (as defined in ¶ 25 below), have reached a proposed settlement of the Action for $3,500,000 in cash that, if approved, will resolve all claims, whether known or unknown, in the Action (the “Settlement”).

Print publication will be made in Canada, in the English language in the business section of the national weekend edition of The Globe and Mail, the Gazette, and in the French language in the business section of La Presse.
