Multi-County Park. The County agrees to use its best commercially reasonable efforts to cause the Land to be included in a duly authorized Multi-County Park created pursuant to a qualified Multi-County Park Agreement, which agreement (as extended, or any successor Multi-County Park Agreement) shall terminate no earlier than the termination date of this Agreement. Multi-County Park. Section 4.1. The County will diligently take all reasonable acts to insure that the Project will be included, and will remain, within the boundaries of a multi-county industrial or business park pursuant to the provisions of the Multi-County Park Act on terms which provide, for all jobs created by the Company in the County prior to the end of the Compliance Period, any additional jobs tax credit afforded by the laws of the State for Projects located in multi-county industrial or business parks and which facilitate the Special Source Credits described in Article III hereof.
Multi-County Park. (a) By separate ordinance of the County Council, the County, in cooperation with an adjacent county and with the consent of the City of North Charleston, shall use its best efforts to designate the site of the Project as a multi-county park pursuant to Article VIII, Section 13 of the Constitution of South Carolina, the MCIP Act, and the terms of Agreement for the Establishment of a Multi-County Industrial/Business Park between the County and Colleton County, South Carolina, dated as of September 1, 1995, as amended (the “Park Agreement”). In the FILOT Agreement, the County will agree to use its best efforts to maintain such designation at all times during the term of the FILOT Agreement, but not less than twenty (20) years.

  • Interconnection Facilities 4.1.1 The Interconnection Customer shall pay for the cost of the Interconnection Facilities itemized in Attachment 2 of this Agreement. The NYISO, in consultation with the Connecting Transmission Owner, shall provide a best estimate cost, including overheads, for the purchase and construction of its Interconnection Facilities and provide a detailed itemization of such costs. Costs associated with Interconnection Facilities may be shared with other entities that may benefit from such facilities by agreement of the Interconnection Customer, such other entities, the NYISO, and the Connecting Transmission Owner.

  • Participating TO’s Interconnection Facilities The Participating TO shall design, procure, construct, install, own and/or control the Participating TO’s Interconnection Facilities described in Appendix A at the sole expense of the Interconnection Customer. Unless the Participating TO elects to fund the capital for the Participating TO’s Interconnection Facilities, they shall be solely funded by the Interconnection Customer.

  • City CITY’s DIRECTOR, or his or her designee, shall be the CITY official responsible for the Program and shall render overall supervision of the progress and performance of this AGREEMENT by CITY. All services agreed to be performed by CITY shall be under the overall direction of the DIRECTOR.

  • State Facilities If the State makes space available to the Party in any State facility during the term of this Agreement for purposes of the Party’s performance under this Agreement, the Party shall only use the space in accordance with all policies and procedures governing access to and use of State facilities which shall be made available upon request.
