Limitation of Operation. It is understood that this ground lease to construct a hangar for which this agreement is written may be used only for storage, repair and activities relating to aircraft and aviation.  INSPECTION OF BUILDING. RCAC will periodically inspect any property on said leased property to verify compliance with approved aeronautical activities on the Airport. Non-compliance of the lease terms may result in termination of said GROUND LEASE and eviction from the Airport  HANGAR BUILDING. Plans for construction or alteration of hangars or other buildings at the airport must be submitted to RCAC for review and approval and may require FAA Form 7640-1, “Notice of Proposed Construction or Alteration”.  AMOUNT OF RENTAL. The Lessee shall pay to the RCAC $ per year, on a calendar year basis, payable in advance, and Lessee shall not be entitled to a refund for any reason whatsoever. RCAC shall have the authority to raise the rental payment annually at a rate not greater than 12%.

Disposal of Additional Litter and Debris - All Additional litter and debris that have been accumulated and picked up shall be placed in trash bags and removed from retention areas and right-of-ways at the end of each working day by the Contractor. Disposal of litter and debris shall be made in accordance with local and state laws and any cost incurred for disposal shall be the responsibility of the Contractor. Storage or stockpiling of litter or debris on the retention areas or right- of-ways shall not be permitted. With each invoice submittal the Contractor shall provide the landfill receipts where the Contractor disposed all additional litter or debris.

  • Resumption of Operations In the event of action prohibited by Section 1 above, the Union immediately shall disavow such action and request the employees to return to work, and shall use its best efforts to achieve a prompt resumption of normal operations. The union, including its officials and agents, shall not be liable for any damages, direct or indirect, upon complying with the requirements of this Section.

  • Cessation of Operations Any cessation of operations by Borrower or Borrower admits it is otherwise generally unable to pay its debts as such debts become due, provided, however, that any disclosure of the Borrower’s ability to continue as a “going concern” shall not be an admission that the Borrower cannot pay its debts as they become due.

  • SUSPENSION OF OPERATIONS Concessionaire shall, at the direction of Department, immediately suspend, delay or interrupt Concessionaire’s operation of all or any part of the Concession Premises for such period of time as Department may determine to be appropriate to protect the Concession Premises and/or public health, safety, and welfare due to the occurrence of hazardous work conditions, emergency conditions, and/or any other cause including, but not limited to, Concessionaire's failure to perform any of the covenants, agreements, and conditions contained in this Agreement on its part to be performed. Concessionaire hereby waives any claim, and Department shall not be liable to any party claiming through Concessionaire, for damages, payment abatement, or compensation as a result of Department's actions under this Paragraph or this Agreement. Department's suspension of Concessionaire's operations shall be in addition to any other right or remedy available by law or in equity.

  • CONTINUITY OF OPERATION Section 1: No Strikes, Work Stoppages or Lockouts Neither of the parties shall utilize any economic sanction to force its position on the other party over any issue. Further, no Employee or group of Employees shall individually or through concerted action, take part in any activity that impedes the operation of the business, except as otherwise authorized by this Agreement. Should any person or group of people participate in any such unauthorized activity, upon notification of such occurrence, the Union or the Company, as the case may be, will direct such person or group of people to resume normal operations and will take effective means to cease the unauthorized conduct. Any employee or group of employees who participate in such unauthorized activity shall be subject to immediate dismissal, unless mitigating circumstances exist that are acceptable to the ERRC. Should either party suffer financial damage as a result of such unauthorized activity, they may pursue compensation for such loss at the arbitration step of the Concern Resolution Process, and the arbitrator shall have full authority to remedy any violation of this Article.

  • HOURS OF OPERATION AND LIMITATIONS A. During the Initial Term and any subsequent Renewal Term(s) of this Agreement, the Concession shall open and operate from the Saturday before Memorial Day through Labor Day (“Period of Operation”). For the Initial Term of this Agreement, any calendar day(s) prior to the Period of Operation, and the ten (10) calendar days after Labor Day, which comprise the remainder of this Agreement’s Initial Term, are solely to allow for Concession set-up and take-down, respectively. For any subsequent Renewal Term(s), the ten (10) calendar days prior to the Saturday before Memorial Day and the ten (10) calendar days after Labor Day, which comprise the remainder of any Renewal Term, are solely to allow for Concession set-up and take-down, respectively.

  • Hours of Operation Tenant will carry on its business diligently and continuously in the Premises and will keep the Premises open for business not less than sixteen (16) consecutive hours each day seven (7) days per week, including holidays. Director or his/her representative may, from time to time, change such required hours of operation, in which event, Tenant will remain open during such revised hours. Similarly, Tenant may, from time to time, request to revise its hours of operation. Such change must be approved by Director or his/her representative, in writing, prior to its occurrence. Tenant may not, at any time, vacate or abandon the Premises.

  • AREA OF OPERATION This agreement shall operate throughout the State of Western Australia.

  • TRANSFER OF OPERATIONS Purchaser shall be entitled to immediate possession of, and to exercise all rights arising under, the Assets from and after the time that the Restaurants open for business on the Closing Date, and operation of the Restaurants shall transfer at such time (the "Effective Time").   • Method of Operations The edging of sidewalks, paved approaches, and curbs will create a distinct void; approximately one-half (1/2) inch horizontally between the structure and the turf. String trimmers will not be used in edging. Edging also includes the removal of all sand and debris from the areas designated to be edged. Upon completion of edging by the Contractor, no growth, sand or debris will touch any of the structures designated to be edged. The Contractor will remove all sand and debris from the areas designated for edging. The cost of this removal and disposal will be included in the unit price bid for mowing.

  • Commencement of Operations The Partnership shall not begin operations on its Leases unless the Managing General Partner is satisfied that necessary title requirements have been satisfied.
