Nothing in the Prior Agreements, the Confidential Disclosure Agreement, or in the Release (the “Aggregated Documents”) prohibits you from filing a charge with or participating in an investigation conducted by any state or federal government agencies. Any waiver of your right to any relief arising from any Proceeding (as defined in the Release) is subject to compliance with law and, for clarity, does not prevent you from accepting a whistleblower award from the Securities and Exchange Commission pursuant to Section 21F of the Securities Exchange Act of 1934, as amended. Notwithstanding any confidentiality provision in the Aggregated Documents, you may truthfully respond to a lawful and valid subpoena or other legal process, but shall give the Company the earliest possible notice thereof, shall, as much in advance of the return date as possible, make available to the Company and its counsel the documents and other information sought, and shall assist the Company and such counsel in resisting or otherwise responding to such process.
