Updates and Upgrades. Contractor grants to the Department a non-exclusive, non-transferable license to use upgrades and updates provided by Contractor during the term of the Contract. Such upgrades and updates are subject to the terms of the Contract. The Department shall download, distribute, and install all updates as released by Contractor during the length of the Contract, and Contractor strongly suggests that the Department also downloads, distributes, and installs all upgrades as released by Contractor during the length of the Contract. Contractor shall use commercially reasonable efforts to provide the Department with work-around solutions or patches to reported software problems that may affect the Department’s use of the software during the length of the Contract.
Updates and Upgrades. 3.13.1 The nature of Updates and Upgrades is that they are improvements and/or enlargements to the Software, and that functions thus can be changed or removed compared to the version being replaced. It is the Licensee’s sole responsibility to ensure that an Update or Upgrade is fit for purpose and works together with the Licensee’s hardware and with the Licensee’s data. The Licensee understands that newer versions of third party software and newer hardware might be required in order to use an Update or Upgrade.

The SaaS Services are designed to support a multi-tenant cloud based offering and shall be Updated and Upgraded in Grass Valley’s discretion, and all Updates or Upgrades shall be implemented and deployed at Grass Valley’s discretion. Customer may not opt out of an Update or Upgrade. Updates and Upgrades are licensed on the same terms and conditions as applicable to the SaaS Services under this Agreement.
Updates and Upgrades. We may from time to time provide updates or upgrades to the App (each a "Revision"), but are not under any obligation to do so. Such Revisions will be supplied according to our then-current policies, which may include automatic updating or upgrading without any additional notice to you. You consent to any such automatic updating or upgrading of the App. All references herein to the App shall include Revisions. This Agreement shall govern any Revisions that replace or supplement the original App, unless the Revision is accompanied by a separate license agreement which will govern the Revision.
