Southpark for cleaning, repairs, or late rent charges as reflected on the final account statements for all Participating Class Members during the Class Period, and (b) multiplying the result by each individual Participating Class Member’s amount of security deposit withheld by L.A. Southpark for cleaning, repairs, or late rent charges as reflected on the Participating Class Member’s Final Account Statement divided by the number of tenants on the residential lease.
Individual Class Payments. The Administrator will calculate Individual Class Payments using the following formula: The Net Settlement Amount will be allocated among Participating Class Members on a proportional basis based on the number of Work Weeks worked during the Class Period and whether the Participating Class Member experienced a termination between May 5, 2018 and the end of the Class Period. Participating Class Members shall be allocated one (1) points of credit for each Work Week they worked within the Class Period and five (5) points 24 of credit if the Participating Class Member experienced a termination between May 5, 2018 and the 25 end of the Class Period. One day worked in a given week will be credited as a Work Week for purposes of these calculations. To calculate each Class Member’s proportional share, the Administrator will (i) Add all points for all Participating Class Members to obtain the Denominator; (ii) Divide the number 1 of points for each Participating Class Member by the Denominator to obtain each Class Member’s 2 portion of the Net Settlement Amount; (iii) Multiply each Participating Class Member’s portion of the 3 Net Settlement Amount by the Net Settlement Amount to determine each Class Member’s estimated 4 individual settlement payment of the Net Settlement Amount.
Individual Class Payments. LEGOLAND will pay the Net Settlement Amount to Class Members who do not exclude themselves from the Settlement (“Participating Class Members”). Each Participating Class Member’s share of the Net Settlement Amount (the “Individual Class Payment”) will be based on the number of workweeks each Participating Class Member worked for LEGOLAND in California in a non-exempt position on at least one day during the Class Period. Each Individual Class Payment shall be calculated by dividing a Participating Class Member’s individual workweeks by the total of all Participating Class Members’ workweeks, and multiplying this result by the Net Settlement Amount. The Individual Class Payments will be allocated 20% as wages, 20% as interest, and 60% as penalties and expense reimbursements. The wage component of the Individual Class Payments shall be subject to W-2 reporting and shall be subject to deductions for employee-side employment and payroll taxes. The interest and penalty components of the Individual Class Payments will be subject to IRS Form 1099 reporting, if required by law, and will not be subject to deductions for employment and payroll taxes.

Class Period months will be adjusted as follows: (i) each Class Period month worked by a Class Member who had a company-issued cell phone will be counted as 0.5 months for purposes of the calculation; (ii) each Class Period month worked by a Class Member who entered into an arbitration agreement (and/or signed an employment contract with an arbitration provision) with Fox will be counted as 0.25 months for purposes of the calculation; (iii) each Class Period month worked by a Class Member who sought and was provided reimbursement for personnel cell phone or home internet expenses by Xxx will be counted as 0.25 months for purposes of the calculation; and (iv) each Class Period month worked by a Class Member as a freelance employee will be counted as 0.1 months for purposes of the calculation. If an employee meets the criteria for more than one of the aforementioned adjustments, such adjustments shall not be cumulative, but the adjustment resulting in the greatest reduction shall be applied.
