In accordance with the monitoring and discovery provisions in the Treatment Plan, FC shall report to EPA and SHPO any newly discovered properties or any inadvertent effects on historic properties as described in the Archaeological Monitoring and Site Condition Assessments Section.

Inadvertent Discoveries. None of the investigations being proposed as a part of this project are intended or designed to excavate, uncover, disturb or remove Native American human remains, funerary objects, sacred objects, or objects of cultural patrimony. In the event that human remains, funerary objects, sacred objects, or objects of cultural patrimony are unintentionally exposed by some aspect of research in this study, procedures identified in “Guidance for National Park Service Compliance with the Native American Xxxxxx Protection and Repatriation Act (NAGPRA), NPS Cultural Resource Management Guideline, Appendix R will be followed.

DURATION This Agreement will expire (10) years from the date of its execution. Prior to reaching a final decision on the dispute, the Forest Service shall 563 prepare a written response that takes into account any timely advice or comments 564 regarding the dispute from the Signatory Parties and provide them with a copy of such 565 written response. Inadvertent Discoveries. 24 25 If historic properties are discovered or unanticipated effects on historic properties are found after 26 the Park’s approval of the undertaking and after construction has commenced, the Park shall 27 implement any post review discovery plan developed pursuant to this PA, or if such plan is not in 28 effect shall take reasonable efforts to avoid or minimize, document adverse effects to such 29 properties; determine reasonable actions that can be taken to resolve any adverse effects, and 30 notify the SHPO and any Indian tribe or group that might attach religious and cultural 31 significance to the affected properties within 48 hours of the discovery. 32
