  • Joint Occupational Health and Safety Committee The Employer and the Union recognize the role of the joint Occupational Health and Safety Committee in promoting a safe and healthful workplace. The parties agree that a Joint Occupational Health and Safety Committee shall be established for each Employer covered by this Collective Agreement. The Committee shall govern itself in accordance with the provisions of the Industrial Health and Safety Regulations made pursuant to the Workers’ Compensation Act. The Committee shall be as between the Employer and the Union, with equal representation, and with each party appointing its own representatives. Representatives of the Union shall be chosen by the Union membership or appointed by the Union. All minutes of the meetings of the Joint Occupational Health & Safety Committee will be recorded in a mutually agreeable format and will be sent to the Union. The Union further agrees to actively pursue with the other Health Care Unions a Joint Union Committee for the purposes of this Article. The Employer agrees to provide or cause to be provided to Employer members of the Joint Occupational Health and Safety Committee adequate training and orientation to the duties and responsibilities of committee members to allow the incumbents to fulfil those duties competently.   • Accident Prevention Health and Safety Committee The Employer and the Union agree that they mutually desire to maintain standards of safety and health in the Hospital in order to prevent accidents, injury and illness, its responsibilities under the applicable legislation, the Hospital agrees to accept as a member of its Accident Prevention Health Safety Committee at least one representative selected or appointed by the Union from amongst bargaining unit employees. ARTICLE PAID The holidays with pay for this Agreement shall be: New Year's Day Good Friday Easter Monday Victoria Day Dominion Day Civic Holiday (as locally declared) Labour Day Thanksgiving Day Christmas Day Boxing Day During the term of this agreement, additional holiday, the Float which is not a day, shall be granted, namely the third Monday February. If the Government proclaims a different day in February, that day shall replace this holiday. Due to the nature of t h e services necessary in a Hospital, many of the employees be required to work on these holidays. In general, employees may be to alternate with each other in being absent work on holidays for instance, an employee having Christmas Day off might not be allowed off on New Year's Day. An employee required to work on of the foregoing holidays shall be paid at time and one half his regular straight time rate of pay for time worked on such holiday in addition to any holiday pay to which he may be entitled or at the option of the Hospital the employee may be paid time and one half for the time worked and a paid day off in lieu thereof, (or a further option of the Hospital), the employee may be paid his regular straight plus a paid day and a half off in lieu thereof. Failure to report for work assigned on such disqualify an employee for holiday pay. For the purpose of clarity, the holiday pay as provided for in this Article will be computed on the basis of the number of hours the employee is normally scheduled to work on a regular working day at his regular rate of pay. The day classified as a paid holiday is that in which the majority of hours worked fall within the commencement at midnight of the day before the actual paid holiday until midnight of the actual paid holiday. Where an employee is required to work overtime in excess of his regularly hours on a paid holiday (but not including hours on a subsequent regularly scheduled shift) such shall receive two and one half times his regular straight time hourly rate for such additional overtime. VACATIONS Vacations with pay will be granted on the basis of vacation periods, calculations of continuous employment and distributions being based on a vacation fiscal year. This fiscal year will be from May to April Effective October entitlement shall be as follows: Registered Nursing Assistants and Technicians who have completed one year or more of continuous service by April of any year shall receive an annual vacation of three weeks with pay at their regular rate of pay. Employees (other than Registered Nursing Assistants and Technicians) who have completed less than one year of continuous services as of' April shall be entitled to two weeks' annual vacation. Payment for such vacation shall be prorated in accordance with his/her service. Employees (other than Registered Nursing Assistants and Technicians) who have completed one year but less than three years of continuous service as of April shall be to two weeks' annual vacation with pay. Employees (other than Registered Nursing Assistants and Technicians) who have completed three years but less than eight years continuous service as of April shall be entitled to three Weeks' annual vacation with pay. An employee who has completed eight years but less than seventeen years of continuous service of April shall be entitled to four weeks' annual vacation with pay. An employee who has completed seventeen or more years of continuous service as of April shall be entitled to five weeks' vacation with pay. Vacation pay shall be calculated on the basis of the employee's regular straight time rate of times their 1 weekly hours of work, subject to the application of the Effect of Absence provision. An employee who leaves the employ of the Hospital for reason shall be entitled to receive any unpaid vacation pay which has accrued to his date of separation.
