ETU Shop Stewards Rights and Charter. The parties to this Agreement recognise the important role the Shop Stewards play in representing the Union at their workplace. The Shop Stewards have a key role in the early intervention of industrial disputes and Health & Safety issues. Shop Stewards shall be allowed all time necessary during working hour to attend to Industrial and Occupational Health & Safety matters on behalf of the employees and the Union. Shop Stewards shall be engaged as employees and perform normal work when not representing their fellow workers or the Union on legitimate business. Shop Stewards shall have no role in determining which employees work overtime or otherwise, however they may have a role in ensuring agreed overtime rosters are fairly and properly implemented. On major projects the main Electrical Contractor may employ a Shop Xxxxxxx and / or Occupational Health & Safety representative. In accordance with this Agreement, the parties shall make every effort to ensure arrangements are in place with the client and other relevant contracting companies and, that the cost of employing the Shop Xxxxxxx and / or Occupational Health & Safety representative are equally proportioned between the client and / or other relevant Companies involved. This Clause is to be applicable to commence 1st January 2003. Prior to a Shop Xxxxxxx being terminated from employment or being transferred from a site or project, the Company shall notify the relevant official of the Union two weeks in advance of such termination or transfer. The Company cannot give payment in lieu of notice unless otherwise agreed by the parties. Where the Company considers that the Shop Xxxxxxx is exceeding this Charter, or otherwise unreasonably disrupting Company operations, the matter shall be referred to the Electrical & Communication Industry Disputes Board in accordance with Clause 12.3 of this Agreement. This shall also apply to Health & Safety representatives.

  • Responsibilities and Restrictions Concerning Governing Body, Officers and Employees Grantee and its governing body will:

  • Rights of Stewards When it is necessary for a xxxxxxx to leave his/her work area to investigate and adjust grievances or to investigate a specific problem to determine whether to file a grievance, the xxxxxxx shall request permission from the immediate supervisor and such request shall not be unreasonably denied. In the event the duties require the xxxxxxx leave the work area and enter another area within the installation or post office, the xxxxxxx must also receive permission from the supervisor from the other area he/she wishes to enter and such request shall not be unreasonably denied. The xxxxxxx, chief xxxxxxx or other Union representative prop- erly certified in accordance with Section 2 above may request and shall obtain access through the appropriate supervisor to review the documents, files and other records necessary for processing a grievance or determining if a grievance exists and shall have the right to interview the aggrieved employee(s), supervisors and witnesses during working hours. Such requests shall not be unreasonably denied. While serving as a xxxxxxx or chief xxxxxxx, an employee may not be involuntarily transferred to another tour, to another station or branch of the particular post office or to another independent post office or installation unless there is no job for which the employee is qualified on such tour, or in such sta- tion or branch, or post office. If an employee requests a xxxxxxx or Union representative to be present during the course of an interrogation by the Inspection Service, such request will be granted. All polygraph tests will continue to be on a voluntary basis.

  • GRIEVANCE PROCESS RIGHTS No grievant shall lose his/her right to process his/her grievance because of Management-imposed limitations in scheduling meetings.

  • Retention of Rights and Privileges 8.01 Should the Employer merge, amalgamate or combine any of its operations or functions with another organization during the term of this Agreement, the Employer, through whatever merger agreement involved, agrees that all benefits and conditions of employment held by the employees shall be integrated and shall not be adversely affected.

  • EMPLOYEE RIGHTS AND PRIVILEGES X. Xxxxxxxx to Chapter 123, Public Laws 1975, the Board hereby agrees that every employee of the Board shall have the right freely to organize, join and support the Association and its affiliates for the purpose of engaging in collective negotiations and other concerted activities for mutual aid and protection. As a duly selected body exercising governmental power under the law of the State of New Jersey, the Board undertakes and agrees that it shall not directly or indirectly discourage or deprive or coerce any employee in the enjoyment of any rights conferred by Chapter 123, Public Laws of 1975 or other laws of New Jersey or the Constitution of New Jersey and the United States; that it shall not discriminate against any employee with respect to hours, wages, or any terms or conditions of employment by reason of his/her membership in the Association and its affiliates, his/her participation in any activities of the Association and its affiliates, collective negotiations with the Board, or his/her institution of any grievance, complaint or proceeding under this Agreement or otherwise with respect to any terms or conditions of employment.

  • PROCEDURE FOR GRIEVANCES AFFECTING A GROUP OF EMPLOYEES The Union may elect to file a grievance on behalf of two or more employees. The facts and issues of the grievance must be the same.

  • Recognition and Rights of Stewards (a) The Employer recognizes the Union's right to select stewards to represent employees. The Employer and the Union will agree on the number of stewards, taking into account both operational and geographic considerations.

  • Reservation of Managerial Rights The foregoing enumeration of School Board rights and duties shall not be deemed to exclude other inherent management rights and management functions not expressly reserved herein, and all management rights and management functions not expressly delegated in this Agreement are reserved to the School Board.

  • EMPLOYEE RIGHTS AND PROTECTION A. Nothing contained within this Agreement shall be construed to deny or restrict to any employee rights he/she may have under the Michigan School Laws or the applicable laws and regulations. The rights granted to employees hereunder shall be deemed to be in addition to those provided elsewhere.

  • PRESERVATION OF RIGHTS AND ENTITLEMENT Notwithstanding anything in this Agreement, Maybank’s rights and entitlement under this Agreement shall continue to remain in full force and effect and shall survive any cancellation, revocation or suspension of the Credit Card by Maybank.
