End of Year Position. (including the Management of Surpluses & Deficits) At the end of the financial year the Council will carry out a reconciliation exercise to identify the costs incurred directly by the Council in relation to the Service & Financial Agreement. The Trust will provide the Council with details of expenditure incurred in delivering the services within the Service & Financial Agreement. The balancing payment will be determined once the two figures have been collated. Decisions regarding the application of any surplus will be jointly made by the Council MH Commissioner and a nominated officer of the Trust. The Trust is not authorised to over spend in relation to the Service and Financial Agreement funding. If, however, it is agreed that a potential over spend cannot be contained the Council Mental Health Commissioner and a nominated officer of the Trust must agree how it is to be financed ahead of such an occurrence. Overspends that do not arise through planned variances as set out in the Service and Finance Agreement will be presumed to be carried forward to the following financial year and a recovery plan agreed with the Commissioner.

  • Return to Position Upon return from FMLA leave, the employee shall be returned to the same or equivalent position in the same class and work location, including the same shift or equivalent schedule, unless the University and the employee agree in writing to other conditions and terms under which such leave is to be granted.

  • Return to Former Position (a) An employee who has had at least 12 months' continuous service with an employer immediately before commencing part-time employment after the birth or placement of a child has, at the expiration of the period of such part-time employment or the first period, if there is more than one, the right to return to his or her former position.

  • Filling Positions ‌ The Employer will determine when a position will be filled, the type of appointment to be used when filling the position, and the skills and abilities necessary to perform the duties of the specific position within a job classification. Only those candidates who have the position-specific skills and abilities required to perform the duties of the vacant position will be referred for further consideration by the employing agency.

  • Vacant Position An approved position which is reflected in the budget complement, which may have been vacated due to death, resignation, retirement, non-renewal, termination, or reassignment.

  • Work Period The normal work period shall consist of forty (40) hours of work within a seven (7) day period or eighty (80) hours of work within a fourteen (14) day period.

  • Permanent Positions All part-time and full-time positions shall be permanent unless identified as being fixed term in accordance with clause 2.2.5.

  • VACANCIES, TERM POSITIONS AND NEW POSITIONS 3001 Subject to section 3002 herein, the Employer agrees to post notices of vacant, term or new positions covered under this Agreement for at least seven (7) days to enable nurses presently in the employ of the Employer to apply for same. Such posting shall not preclude the Employer from advertising outside the site premises. All postings shall state minimum qualifications required, the equivalent to full-time (E.F.T.) and date of closing of the competition. Job descriptions shall be available to applicants on request. 3002 The Employer will be required to post a notice of vacancy for only five (5) days for a vacancy that is created by:

  • Leave Year The leave year begins with the first full payroll period of a calendar year and ends with the payroll period in which December 31st falls.
