Employee Recalls. When employees are recalled to work following layoffs for lack of work or funds, they shall be recalled to the job classification from which they were initially laid off. The laid off employees with the most job classification seniority who can satisfactorily perform the work involved with a break-in but without training period shall be the first to be recalled.

Employee Recalls. Employees who have been laid off shall be recalled to vacant positions within their level and category depending upon qualifications, performance, and seniority, within a two (2) year period immediately following the effective date of the layoff. Prior to the position being filled, such employees shall have the right to be considered for any other vacancies for which they are qualified. Notice of recall shall be by certified mail and forwarded to the employee within seventy-two (72) hours of when the vacancy becomes available in the District. Notice shall be sent to the employee's last known address. If the employee does not indicate his/her acceptance of the position within fifteen (15) calendar days after receiving the recall notice, he/she shall be deemed to have refused the position and waived further recall rights under this Agreement. Failure of an employee to accept a recall position with fewer hours or workdays than that of the position from which he/she was laid off shall not constitute a waiver of recall rights.

The recall notice shall state the time and date on which the bargaining unit member is to report back to work. It shall be the bargaining unit member’s responsibility to keep the Employer notified as to his/her current mailing address.

  • Employee Relations Committee The parties agree to establish and maintain a joint Employee Relations Committee, which shall consist of three (3) representatives of the Association appointed by the President of the Association and three (3) management representatives appointed by the Board of Higher Education acting through the Council of Presidents. The representatives of the parties may be accompanied by advisors of their choosing at any meeting of the Employee Relations Committee. The Association and the Board of Higher Education acting through the Council of Presidents shall each designate a spokesperson who shall be the authorized agent of each party in the discharge of its responsibilities under this Section. Meetings of the Employee Relations Committee will be scheduled monthly, and on the call of either party, through its spokesperson. Special meetings shall be scheduled at mutually agreeable times, but not later than five (5) working days from the date of receipt of the request. Special meeting requests may be made orally or in writing by the spokesperson of either party to the other and shall specify the reasons for which such special meeting is requested. The spokesperson of the Association shall serve and preside as Chair at the first meeting; thereafter, the role of Chair will alternate between the spokesperson of the Association and the spokesperson of the Council of Presidents. A representative of the party not chairing the meeting will take minutes of the meeting. The parties agree that their representatives shall have the authority and power to reach agreements, settlements, and other adjustments on their behalf. Minutes of each meeting should be signed within forty-five (45) days after such meeting. The Committee shall sponsor and arrange for a contract orientation meeting to be held at a State University on October 1, 2019. Each Chapter President and a person appointed by him/her and two (2) persons designated by the President of each University shall attend representing the parties at each University.

  • Labor and Employee Relations (i) (A) None of the employees of the Company or any of its Subsidiaries is represented in his or her capacity as an employee of such company by any labor organization; (B) neither the Company nor any of its Subsidiaries has recognized any labor organization nor has any labor organization been elected as the collective bargaining agent of any of their employees, nor has the Company or any of its Subsidiaries signed any collective bargaining agreement or union contract recognizing any labor organization as the bargaining agent of any of their employees; and (C) to the Knowledge of the Company, there is no active or current union organization activity involving the employees of the Company or any of its Subsidiaries, nor has there ever been union representation involving employees of the Company or any of its Subsidiaries.

  • Employee Removal At District’s request, Contractor shall immediately remove any Contractor employee from all District properties in cases where the District in its sole discretion determines that removal of that employee is in the District’s best interests.

Such application shall be considered on a case-by-case basis and granted at the discretion of the employer. There will be no right of review. All service related provisions/ benefits will be put on hold until resumption of normal duties.
