Duplicate Reports. Customer may run a LoanSafe report on a property address that was previously run in the prior 90 days, up to a maximum of three times, for real property data and any such duplicate report shall not be calculated against the Annual Volume Cap (“Property Duplicate Report”). Customer may run a LoanSafe report requesting borrower data on a property address that was previously run in the prior 90 days, one time only and only for 75% of the original monthly reports, and any such duplicate report shall not be calculated against the Annual Volume Cap (“Borrower Duplicate Report”). For example, if Customer created 100 LoanSafe original reports in July 2008 and, within 90 days, requested 80 Borrower Duplicate Reports from those July 2008 original reports, 75 Borrower Duplicate Reports would be free of charge and not count towards the Annual Volume Cap; the other 5 Borrower Duplicate Reports would count towards the Annual Volume Cap (assuming Customer had not exceeded the Annual Volume Cap).

Duplicate Reports. If a third party requests a summary of Report information or a copy or duplicate of a Report for an Article that was last submitted to GIA by Client for grading or other Services (including without limitation any Articles submitted by Client prior to the date of this Agreement), or if Client authorizes GIA to provide a copy of a Report to a third party by providing GIA with prior written notice that states the name of the third party authorized to receive any Reports from GIA and authorizes GIA to communicate with such third party regarding the results contained in such Reports, then GIA may, in its discretion, issue such a summary of the information in the most recent Report for such Article, or a copy or duplicate of the most recent Report for the Article, and communicate with such third party regarding the results contained in the most recent Report for the Article. GIA may charge the third party certain fees for summaries of Report information and copies or duplicates of Reports, as determined by GIA in its sole discretion. IF CLIENT REQUESTS A COPY OR DUPLICATE OF A REPORT, THEN CLIENT ACKNOWLEDGES THAT SUCH COPY OR DUPLICATE OF A REPORT IS NOT A GIA REPORT. THE INFORMATION CONTAINED IN THE COPY OR DUPLICATE REPORT REPRESENTS THE INFORMATION DESCRIBED ON THE ORIGINAL GIA REPORT AS OF THE DATE SET FORTH ON SUCH GIA REPORT (I.E., THE DATE THE ARTICLE WAS GRADED, TESTED, EXAMINED OR ANALYZED BY THE GIA LABORATORY). A COPY OR DUPLICATE OF A REPORT IS NOT A GUARANTEE, VALIDATION, OR WARRANTY OF ANY KIND REGARDING THE ARTICLE, INCLUDING WITHOUT LIMITATION THE ARTICLE’S CURRENT QUALITY OR CHARACTERISTICS. ALL OF THE LIMITATIONS INCLUDED ON THE ORIGINAL GIA REPORT APPLY. THE RECIPIENT OF A COPY OR DUPLICATE OF A REPORT MAY WISH TO CONSULT A CREDENTIALED JEWELER OR GEMOLOGIST ABOUT THE INFORMATION CONTAINED IN SUCH REPORT.

  • Late Reports If the General Partner does not fulfill its obligations under Section 14.2 within the time periods set forth therein, the General Partner, using its own funds, shall pay as damages the sum of $100 per day (plus interest at the rate established by Section 6.4 of this Agreement) to the Limited Partner until such obligations shall have been fulfilled. If the General Partner does not fulfill its obligations under Section 14.3 within the time periods set forth therein, the General Partner, using its own funds, shall pay as damages the sum of $100 per week (plus interest at the rate established by Section 6.4 of this Agreement) to the Limited Partner until such obligations shall have been fulfilled. If the General Partner shall so fail to pay, the General Partner and its Affiliates shall forthwith cease to be entitled to any fees hereunder (other than the Development Fee) and/or to the payment of any Net Operating Income or Sale or Refinancing Proceeds to which the General Partner may otherwise be entitled hereunder. Payments of fees and Distributions shall be restored only upon payment of such damages in full.

  • Accurate Reports No Information Package or Interim Information Package (if prepared by such Seller Party, or to the extent information therein was supplied by such Seller Party) or other information, exhibit, financial statement, document, book, record or report furnished or to be furnished by or on behalf of such Seller Party to any Agent or any Investor pursuant to this Agreement was or will be inaccurate in any material respect as of the date it was or will be dated or (except as otherwise disclosed to such Agent or Purchaser at such time) as of the date so furnished, or contained or (in the case of information or other materials to be furnished in the future) will contain any material misstatement of fact or omitted or (in the case of information or other materials to be furnished in the future) will omit to state a material fact or any fact necessary to make the statements contained therein not materially misleading in light of the circumstances made or presented.

  • Final Reports Within ninety (90) days of receipt of the Required Documents, the Asset Representations Reviewer shall publish its findings to the Sponsor and the Indenture Trustee. The Asset Representations Reviewer shall provide the Sponsor and the Indenture Trustee with the following reports as a result of the Asset Representations Review (collectively, the “Final Reports”):

  • Servicing Reports Seller shall deliver and cause each Servicer to deliver to Buyer and Custodian a monthly remittance report on or before the second Business Day immediately preceding each monthly Remittance Date containing servicing information, including those fields reasonably requested by Buyer from time to time, on an asset by asset and in the aggregate, with respect to the Purchased Assets for the month (or any portion thereof) before the date of such report

  • Information Packages As soon as available and in any event not later than two (2) Business Days prior to each Settlement Date, an Information Package as of the most recently completed Fiscal Month.

  • Preservation of Information; Communications to Certificateholders (a) The Certificate Registrar shall preserve, in as current a form as is reasonably practicable, the names and addresses of Certificateholders received in its capacity as the Certificate Registrar and provide a copy thereof to the Owner Trustee and Certificate Paying Agent; provided, however, that so long as the Certificate Paying Agent is the Certificate Registrar, no list separate from the Certificate Register shall be required to be provided to the Certificate Paying Agent.

  • Reports to the Trustee; Certificate Account Statement Not later than 15 days after each Distribution Date, the Master Servicer shall forward a statement, certified by a Servicing Officer, to the Trustee setting forth the status of the Certificate Account as of the close of business on such Distribution Date and showing, for the period covered by such statement, the aggregate of deposits into and withdrawals from the Certificate Account for each category of deposit specified in Section 3.04 and each category of withdrawal specified in Section 3.05, and stating that all distributions required by this Agreement have been made (or if any required distribution has not been made, specifying the nature and amount thereof). The Trustee shall make available such statements to any Certificateholder upon request at the expense of the Master Servicer. Such statement shall also, to the extent available, include information regarding delinquencies on the Mortgage Loans, indicating the number and aggregate Principal Balance of Mortgage Loans which are one, two, three or more months delinquent, the number and aggregate Principal Balance of Mortgage Loans with respect to which foreclosure proceedings have been initiated and the book value of any Mortgaged Property acquired by the Trust through foreclosure, deed in lieu of foreclosure or other exercise of the Trust's security interest in the Mortgaged Property.

  • Information Package On each Reporting Date the Master Servicer shall deliver to the Administrative Agent and each Purchaser Agent, on behalf of such Purchaser Agent’s Purchaser Group, the relevant Information Package.

  • Administrator’s Certificate; Servicer’s Report (a) On or before the tenth day of each month (or, if any such day is not a Business Day, on the next succeeding Business Day), the Servicer shall deliver to the Administrator a Servicer’s Report with respect to the preceding month containing all information necessary for the Administrator to receive in connection with the preparation of the Administrator’s Officers’ Certificate covering such calendar month referred to in Section 3.1(b) below.
