CONTINUOUS PERFORMANCE PLEDGE. 9.01 The Union agrees not to cause, actively support any strike, slow down, or other work stoppage during the term of this Agreement. In the event that the Union violates this section, the Board shall notify the President of the Local by receipted written communication to immediately order all Employees to resume normal work activities.
CONTINUOUS PERFORMANCE PLEDGE. 6.01 The Union and any and all of its members shall not cause, engage in, or sanction any strike, slow-down, or any other such concerted action against the Big Walnut School District for the term of this Agreement. In the event of a strike following the expiration of this Agreement, the Union and its members will remain on strike until resolution of a Tentative Agreement. Any return to service for any portion of a school day during such strike will be deemed abandonment of the strike regardless of any strike notice to the contrary.

In the event that the Union violates this provision, it shall be subject to appropriate penalties by the Board, provided that any disputes pertaining to employee discipline shall be subject to the grievance procedure. In recognition of this continuous performance pledge, the Board agrees there will be no "lock-out" of members of the Union except if such "lock-out" is a result of the Board's inability to pay which results in the closing of all schools. Any dispute as to whether this provision has been violated shall be subject to the grievance procedure. Any employee who initiated or participates in a strike or other act prohibited by this Article will be subject to disciplinary action by the Board; provided, however, that the question of such participation shall be subject to the grievance procedure set forth in Article 7. The Union will make every reasonable effort to prevent or terminate violations of this Article.
CONTINUOUS PERFORMANCE PLEDGE. 6.1 The Association shall not sanction or authorize a strike, slowdown or work stoppage for the duration of this Contract.

In the event that the Association violates this provision, it shall be subject to appropriate legal penalties and the Board shall be entitled to any other appropriate relief available under law.
CONTINUOUS PERFORMANCE PLEDGE. A. The members of the Association agree that they will neither cause nor sponsor any strike, slow-down, or other work stoppage as defined by O.R.C. 4117.01 during the term of this Agreement. In the event that the Association or any of its members violate this provision, they shall be subject to appropriate penalties as determined by the Board of Education in accordance with O.R.C. 4117.23.
