The "By the Hirer" clause outlines the rights and procedures available to the party hiring goods or services (the Hirer) to terminate the agreement. By the Hirer in the event that the Hirer cancels a booking, the full charge will be payable unless a replacement hire booking is obtained in which case the YMCA, at its discretion, may waive up to 50% of the hire charge. When such cancellation is made by the Hirer who is a regular booking, the YMCA may, at its absolute discretion, waive payment of the hire charge provided that the Hirer gave the Centre Manager not less than fourteen (14) days’ notice of such cancellation.
By the Hirer. The Hirer is advised to take out holiday insurance in case it has to cancel the Holiday Accommodation.
By the Hirer. If the Hirer cancels a booking with less than 28 days’ notice, full fees will be forfeited. If the Hirer cancels a booking with more than 28 days’ notice, then half the charge will be forfeited. The Headteacher must receive a letter of cancellation before a booking can be cancelled.
By the Hirer. If The Hirer wishes to cancel the booking before the date of the event and The Committee is unable to conclude a replacement booking, the question of the payment or the repayment of the fee shall be at the discretion of The Committee.
By the Hirer. If the booking is cancelled 28 days or more before the booking date then a full refund will be made By the WCPHCT. The WCPHCT reserves the right to cancel a booking by written notice to the Hirer in the following circumstances:
By the Hirer. (i) Should the Hirer cancel a confirmed booking, The University reserves the right to impose the following cancellation charges: More than 12 weeks 0% - All deposits returned 4 to 12 weeks 25% * 1 to 4 weeks 50% * Less than 1 week 100%* - Full payment * after deduction of any advance payments or deposits
(ii) Any costs incurred for a special request, that otherwise would not have been incurred will be charged for, unless the University are able to mitigate this loss.
(iii) Cancellations must be confirmed by the Hirer in writing or via email and will become effective from the date received by the University.
By the Hirer. If the Hirer wishes to cancel the hiring of TOG, in whole or in part, the Hirer must give one month’s written notice to that effect to TOG’s Representative. TOG reserves the right to cancel this hiring in the event of unforeseen circumstances rendering the Premises unfit for use for which it has been hired. The Hirer will be informed by TOG’s Representative at the earliest opportunity. TOG may cancel this Hiring Agreement at any time before or during hiring if the Hirer fails to comply with this Hiring Agreement. In the event of such a cancellation TOG reserves the right to not refund any deposit paid by the Hirer.
By the Hirer. If you wish to cancel your booking please let the Lettings Officer know as soon as possible. Any deposit you have paid will be returned if the Village Hall is able to conclude a replacement booking for the period of your original booking, or in any event if at least 4 weeks’ notice is given. Notice must be in writing (preferably email) and acknowledged by the Lettings Officer. By the Village Hall: The Village Hall reserves the right to cancel this hiring by written notice to the Hirer in the event of • the premises being required for use as a Polling Station for a Parliamentary or Local Government election or by-election • the Village Hall reasonably considering that (i) such hiring will lead to a breach of licensing conditions, if applicable, or other legal or statutory requirements, or (ii) unlawful or unsuitable activities will take place at the premises as a result of this hiring • the premises becoming unfit for the use intended by the Hirer • an emergency requiring use of the premises as a shelter for the victims of flooding, snowstorm, fire, explosion or those at risk of these or similar disasters. In any such case the Hirer shall be entitled to a refund of any deposit already paid, but the Village Hall shall not be liable to the Hirer for any resulting direct or indirect loss or damages whatsoever.
