ACCEPTANCE OF CONTRACT/TERMS AND CONDITIONS. (a) This Contract integrates, merges, and supersedes any prior offers, negotiations, and agreements concerning the subject matter hereof and constitutes the entire agreement between the parties. Neither of the Parties has entered into this Contract in reliance upon any representation, warranty or undertaking of any other party which is not set out or referred to in this Contract and, in the absence of fraud neither party shall be liable to the other for or shall seek to rely upon any such representations. The parties agree that any Non Disclosure Agreement or Proprietary Information Agreement shall not be superseded by this Contract.
ACCEPTANCE OF CONTRACT/TERMS AND CONDITIONS. (a) The Work shall comply with all drawings and specifications referred to in Xxxxx’s request for quote. If Xxxxx’s request for quote refers to Seller’s drawings or specifications for the Work, Xxxxxx agrees to notify Buyer of any changes to its drawings and specifications 60 days prior to implementation of any such change in order to assess the impact of the change.

With the start of a new school term, this student agreement, along with the attached consent form will be sent home with each student enrolling in the Xxxxxx School District. Your parental signature on the consent form is necessary if you want your student to have access to the Internet/Network before returning it to the school where it will be kept on file. Some the these areas are: --Students are required to abide by the Student Internet/Network User Agreement. --Students are to give themselves a unique password and share it with no other person. --Students are not allowed in the computer labs before 8 a.m.unless authorized by school personnel. --Students are not allowed on the Internet unless they are supervised by an authorized adult. --Students are not allowed to make changes to the computer settings that are installed on the machines. --Students are not allowed to hack into other people’s files or computer programs. --Students are not allowed to use inappropriate or obscene language. (Computer Lab supervisors must observe or witness the above violations. Hearsay from students will not constitute or prove guilt.) Punishments for Misuse of the Internet/Network and Computers First Violation: —The student will lose the use of the Internet and computers for 30 school days. (Other than for classroom use.) —The student will lose all study hall privileges (signouts, milk, pop, juice, magazines, newspapers, etc.) for 30 school days. Second Violation: —The student will lose the use of the Internet and computers for 90 school days. (Other than for classroom use.) —The student will lose all study hall privileges (signouts, milk, pop, juice, magazines, newspapers, etc.) for 90 school days. Third Violation: —The student will not be allowed to use the Internet, network, or computers (other than for class) for the remainder of the school term. —The student will lose all study hall privileges (signouts, milk, pop, juice, magazines, newspapers, etc.)...

Unless expressly accepted in writing by GENERAL MICRO SYSTEMS, INC. (BUYER), additional or differing terms or conditions proposed by SELLER or included in SELLER's acknowledgment are objected to by GENERAL MICRO SYSTEMS, INC. and have no effect. For terms of this agreement only, SELLER shall mean “SUPPLIER” of products and/or services; BUYER shall mean “General Micro Systems.” The headings used in these Terms are inserted for convenience of the Parties and shall not define, limit or describe the scope of the intent of the provisions of this contract. In the event that this Contract does not state price or delivery, GENERAL MICRO SYSTEMS will not be bound to any prices or delivery to which it has not specifically agreed in writing.
