Xxxx Property definition

Xxxx Property means all Intellectual Property used or developed by X.xxx to provide the Services, including without limitation the text, software, source code, APIs, photos, sounds, music, videos and interactive features and the trademarks, service marks and logos contained therein.

Xxxx Property means the approximately 400 acres of vacant land in Spokane County, Washington located in an area bounded by US Highway 2 to the west, Xxxxxxx Road to the north, the North/South Freeway to the east, and the Bonneville Power authority east/west power line to the south.

Xxxx Property means all real property owned, directly or indirectly, by the Xxxx Owner.

• Until the construction financing for the Project closes, or earlier, if the DDA consents, the DDA 000 Xxxxx Xxxx Property shall not be mortgaged, pledged or have any liens or encumbrances placed thereon; evidence of this restriction shall be filed with the Register of Deeds if transfer to the Developer takes place prior to the closing on the Developer’s construction financing.

• The portion of the DDA 000 Xxxxx Xxxx Property transferred to the Developer shall be used in the development of Building A; provided that, should Developer be unable to obtain all of its required approvals, permits, and incentives for the construction of Building A, the Land Transfer Agreement shall terminate with no further obligation of either party except those that are specified in the Land Transfer Agreement.

• In witness thereof the parties hereto have set their respective hands on the date and year first above written in the presence of witnesses.

• The Developer, the DDA, and the City shall enter into a written agreement, the “Land Transfer Agreement” (Exhibit F), which describes the transfer of one-third, approximately 2,249 square feet, of the DDA 000 Xxxxx Xxxx Property to Developer for the development of Building A and the remaining two-thirds of the DDA 000 Xxxxx Xxxx Property to the City for the realignment of Xxxxxx Avenue and the expansion of the City parking lot on the northwest corner of Abbot Road and Xxxxxx Avenue.

• The portion of the DDA 000 Xxxxx Xxxx Property necessary for the construction of Building A shall be transferred to the Developer by the DDA in accordance with the terms of this Agreement and a Land Transfer Agreement attached hereto as Exhibit F.

More Definitions of Xxxx Property

Xxxx Property means the mineral claims described in Schedule A that are set out under the title “Xxxx Property”, including any replacement or successor claims, and all mining leases and other mining interests derived from any such claims. Any reference herein to any mineral claim comprising the Properties includes any mineral leases or other interests into which such mineral claim may have been converted;

Xxxx Property. As of the Fifth Amendment Effective Date, the definition of “Xxxx Property” is hereby added to Section 1.01 of the Existing Credit Agreement as follows:

Xxxx Property means the approximately 1.1 acre parcel of land in Xxxxxxx County, West Virginia that MPI purchased from Xxxx X. Xxxx, Xx. and Xxxxxxx X. Xxxx pursuant to the deed dated November 21, 2007 and recorded in the land records of Xxxxxxx County, West Virginia on December 19, 2007 in Deed Book 286, Page 189.

Xxxx Property has the meaning ascribed thereto in Recital E above;

Xxxx Property means the Company’s 100% interest in the Xxxx copper-molybdenum-silver property.

Xxxx Property means the property located in Sterling Heights, Michigan which is ground leased by the Xxxx Project Company pursuant to the Xxxx Ground Lease.

Xxxx Property means (i) any real property and improvements presently owned, leased, used, operated or occupied by the Xxxx Group, and (ii) any other real property and improvements at any previous time owned, leased, used, operated or occupied by the Xxxx Group;
