  • The Secondary Site must have the same functionality as the standard production infrastructure capacity for the Products or Services or Services covered by Disaster Recovery Plan, as it existed at the Primary Site immediately prior to the Disaster, including all hardware, software, infrastructure, applications necessary to maintain such functionality and capacity.

  • In the event of a Disaster requiring the Failover of the Products or Services or Services from the Primary Site to the Secondary Site, Company will rebuild the Primary Site within ninety (90) days of the Disaster event.

  • Notwithstanding this Section 6, in the event the End User makes any use of the Software, Services, or Services not expressly permitted by this Agreement, the End User’s license rights under this Agreement shall immediately and automatically be suspended, including the provision of Software or Services.

  • However, you may be liable for the cost of non-covered Services or Services you obtain from Non-Plan Providers, except for Emergency Services or authorized referrals.

  • Customer may not create derivative works based upon the software provided in the Subscription Services, or Services in whole or in part, or develop or request third parties to develop or modify any software based on ideas, processes, or materials incorporated therein.
