FIRST COMMERCIAL INTRODUCTION definition

FIRST COMMERCIAL INTRODUCTION means the first date upon which a Product is shipped for sale by Spectrum (or by an Affiliate or sublicensee of Spectrum) in the ordinary course of business to a Third Party in any country in the Territory, after Regulatory Approval.

FIRST COMMERCIAL INTRODUCTION means the first date upon which a Product is shipped commercially by ROCHE to an independent third party in a country in the Roche Territory, after formal marketing approval in that country, including any required price approval, has been granted from the relevant authority in that country for that Product.
FIRST COMMERCIAL INTRODUCTION means the first commercial sale by Licensee of any product which incorporates any invention described in the patents and other intellectual property constituting the Licensed Technology within the Field of Use in the United States, Japan or any country that is a member of the European Union.

  • First Commercial Sale means the first sale for use or consumption of any Licensed Product in a country after all required Regulatory Approvals for commercial sale of such Licensed Product have been obtained in such country.
