Definition of "Disability. The definition of "Disability", instead of that provided in this Agreement, shall be determined by the Company or the Participant's Employer and in accordance with the Employer's relevant employment policies, as may be in place from time to time.
Definition of "Disability. As used in this Paragraph 6, "permanent disability" shall mean three (3) months of substantially continuous disability. Disability shall be deemed "substantially continuous" if, as a practical matter, Xxxxxxxxx by reason of her mental or physical health, is unable to sustain reasonably long periods of substantial performance of her duties. Frequent long illnesses, though different from the preceding illness and though separated by relatively short periods of performance, may be deemed to be "substantially continuous." Disability shall be determined in good faith by a vote of not less than 75% of the Board of Directors of the Company, excluding Xxxxxxxxx if she is a director, whose decision shall be final and binding upon Xxxxxxxxx. Xxxxxxxxx hereby consents to medical examinations by such physicians and medical consultants as the Company shall from time to time require.
Definition of "Disability. Disability shall mean an insured employee who has received 52 weeks of benefits under the weekly indemnity plan and who is unable, because of non- occupational disease or accidental bodily injury, to work at his regular occupation or at any other available job in the mill during the next consecutive twelve (12) months, and thereafter is unable to perform any and every duty of every occupation in the mill for which he is reasonably fitted by education, training or experience.

  • Person with a disability means a person who is a citizen or lawful resident of the United States and is a person qualifying as a person with a disability under subdivision (2.1) of this subsection (A).
