Substantial Performance definition

Substantial Performance means the stage of completion when:(a) all Work, as certified by the Contract Administrator, is capable of completion or correction at a cost of not more than:
Substantial Performance means the Work, or a substantial part of it, is ready for use or is being used for the purpose intended;

Examples of Substantial Performance in a sentence

  • General liability insurance shall be maintained from the commencement of the work until one year from the date of Substantial Performance of the Work.

  • Bonds shall be procured from a Nova Scotia resident agent of an insurance company licensed to do business in Nova Scotia and shall be maintained in good standing and held by the Owner until one (1) year after Substantial Performance of the Work.

  • Notwithstanding such passing of title, the Components shall be at the risk of the Contractor until the earlier of the Substantial Performance Date or termination of the Agreement.

  • The Parties acknowledge and agree that because of the nature of the Project it is difficult or impossible to determine with precision of the amount of damages that would or might be incurred by the Owner as a result of Substantial Performance being achieved after the Guaranteed Substantial Performance Date.

  • Notwithstanding and in addition to the foregoing provisions of this Section 7.1, if Substantial Performance does not occur on or before May 1, 2025, the Owner shall be entitled to recover from the Contractor and the Contractor shall pay the Owner as a lump sum, liquidated damages equal to two percent (2%) of the Fixed Contract Price, in addition to any other Delay Liquidated Damages that may be payable by Contractor to Owner from time to time.

Substantial Performance means the date on which all required approvals of public authorities having jurisdiction over the Upgrade have been obtained and the Upgrade is ready for use or is being used for its intended purpose.

Substantial Performance means when the liquefaction plant has achieved, in the aggregate, an average LNG output of at least 70 per cent of the Guaranteed LNG Output over a period of 72 consecutive hours;
