YEAR 2000 READINESS DISCLOSURE. PFPC (a) has reviewed its business and operations as they relate to the services provided hereunder, (b) has developed or is developing a program to remediate or replace computer applications and systems, and (c) has developed a testing plan to test the remediation or replacement of computer applications/systems, in each case, to address on a timely basis the risk that certain computer applications/systems used by PFPC may be unable to recognize and perform properly date sensitive functions involving dates prior to, including and after December 31, 1999, including dates such as February 29, 2000 (the "Year 2000 Challenge"). To the best of PFPC's knowledge and belief, the reasonably foreseeable consequences of the Year 2000 Challenge will not adversely effect PFPC's ability to perform its duties and obligations under this Agreement.

To the best of PFPC Trust's knowledge and belief, the reasonably foreseeable consequences of the Year 2000 Challenge will not adversely effect PFPC Trust's ability to perform its duties and obligations under this Agreement.
YEAR 2000 READINESS DISCLOSURE. (a) The Bank warrants that the Bank's Software which is used to perform the services provided by the Bank under this Agreement is Year 2000 Compliant (as defined below). The term Bank's Software shall mean AIMS, MARS, BTWorld, Globe*View, Globenet and Polaris. Third party software which is also used as part of the services provided by the Bank under this Agreement has been tested at the Bank and found to function in a Year 2000 compliant manner at the Bank; however the Bank does not warrant or assume any responsibility for the Year 2000 compliance of the third party software. Any Year 2000 Compliance determination is made to the Bank's best belief and ability to so determine, based on testing of the Bank's Software within the Bank's own environment as well as scenarios designed to duplicate certain industry environments. Forum acknowledges that to the extent that Forum's system utilizes other software applications, programs and codes, as well as interfaces and data from sources other than the Bank, and to the extent that the Bank uses software from third parties, it may affect the performance of the Bank's Software and there is no assurance that the Bank's Software will operate on Forum's system in a manner that is Year 2000 Compliant.
YEAR 2000 READINESS DISCLOSURE. PFPC (a) has reviewed its business and operations as they relate to the services provided hereunder, (b) has remediated or replaced computer applications and systems controlled by PFPC and which are mission-critical to providing services hereunder (the "Relevant Systems"), and (c) has implemented a testing plan to test the remediation or replacement of the Relevant Systems to address on a timely basis the risk that the Relevant Systems may be unable to process over the January 1, 2000 boundary and on the leap day of February 29, 2000. PFPC represents and warrants that, based on assessments and testing to date, processing errors by the Relevant Systems involving such boundary and leap day are not likely to occur. PFPC will continue to monitor and test the Relevant Systems and make adjustments as necessary.
YEAR 2000 READINESS DISCLOSURE. PNC Bank (a) has reviewed its business and operations as they relate to the services provided hereunder, (b) has developed or is developing a program to remediate or replace computer applications and systems, and (c) has developed a testing plan to test the remediation or replacement of computer applications/systems, in each case, to address on a timely basis the risk that certain computer applications/systems used by PNC Bank may be unable to recognize and perform properly date sensitive functions involving dates prior to, including and after December 31, 1999, including dates such as February 29, 2000 (the "Year 2000 Challenge"). To the best of PNC Bank's knowledge and belief, the reasonably foreseeable consequences of the Year 2000 Challenge will not adversely effect PNC Bank's ability to perform its duties and obligations under this Agreement.
YEAR 2000 READINESS DISCLOSURE. The Administrator (a) has reviewed its business and operations as they relate to the services provided hereunder, (b) has developed or is developing a program to remediate or replace computer applications and systems, and (c) has developed a testing plan to test the redemption or replacement of computer application/systems, in each case, to address on a timely basis the risk that certain computer applications/systems used by the Administrator may be unable to recognize and perform properly date sensitive functions involving the dates prior to, including and after December 31, 1999, including dates such as February 29, 2000 (the "Year 2000 Challenge"). The Administrator represents and warrants that, to the best of its knowledge and belief, the reasonably foreseeable consequences of the Year 2000 Challenge will not adversely effect the Administrator's ability to perform its duties and obligations under this Agreement.
YEAR 2000 READINESS DISCLOSURE. BISYS (a) has reviewed its business and operations as they relate to the services provided hereunder, (b) has developed or is developing a program to remediate or replace computer applications and systems, and (c) has developed a testing plan to test the remediation or replacement of computer applications/systems, in each case, to address on a timely basis the risk that certain computer applications/systems used by BISYS may be unable to recognize and perform properly date sensitive functions involving dates prior to, including and after December 31, 1999, including dates such as February 29, 2000 (the "Year 2000 Challenge").

YEAR 2000 READINESS DISCLOSURE. Seller and Purchaser acknowledge for the benefit of the other that in order to comply with the terms of this Agreement, each Party must become, in a timely manner, "Year 2000 Compliant" (as defined below), both as to its products and services, including the Aircraft, and as to its continuing ability to meet in a timely manner its obligations under this Agreement. Therefore, each Party covenants and agrees that it shall be, in all material respects, Year 2000 Compliant and shall be able to conduct its business and perform its obligations under this Agreement notwithstanding the technological and other issues revolving around the ability of computers and other data processing systems to perform functions correctly which refer to dates or time periods on and after January 01, 2000. "
YEAR 2000 READINESS DISCLOSURE. Fund Accountant (a) has reviewed its business and operations as they relate to the services provided hereunder, (b) has developed or is developing a program to remediate or replace computer applications and systems, and (c) has developed a testing plan to test the remediation or replacement of computer applications/systems, in each case, to address on a timely basis the risk that certain computer applications/systems used by Fund Accountant may be unable to recognize and perform properly date sensitive functions involving dates prior to, including and after December 31, 1999, including dates such as February 29, 2000 (the "Year 2000 Challenge"). Fund Accountant represents and warrants that to the best of its knowledge and belief, the reasonably foreseeable consequences of the Year 2000 Challenge will not adversely effect Fund Accountant's ability to perform its duties and obligations under this Agreement.
YEAR 2000 READINESS DISCLOSURE. The Bank represents that the occurrence in or use by the Bank's own proprietary internal systems (the "Systems") of dates on or after January 1, 2000 (the "Millennial Dates") will not adversely affect the performance of the Systems with respect to date dependent data, computations, output or other functions (including, without limitation, calculating, computing and sequencing) and that the Systems will create, store and generate output data related to or including Millennial Dates without errors or omissions ("Year 2000 Compliance"). The Bank shall promptly notify the Trust of any lack of Year 2000 Compliance of which it becomes aware that impact the Bank's services hereunder. The parties to this Agreement acknowledge that the Bank can make no certification as to the Year 2000 Compliance of third-party systems utilized by the Bank in its day to day operations or with which the Systems interact or communicate, from which the Systems receive data or to which the Systems send data. The parties further acknowledge that while the Bank has contacted such third-party providers regarding Year 2000 Compliance and will use reasonable efforts to monitor the status of such third-party providers' Year 2000 Compliance, failure by such third-party providers to achieve timely Year 2000 Compliance could adversely affect the Bank's performance of its obligations hereunder. The Bank shall promptly notify the Trust of any lack of Year 2000 Compliance of any third-party provider of which it becomes aware that impact the Bank's services hereunder.
