USE OF OUTSIDE TRANSPORTATION SERVICE. 1. The Board may utilize an outside service to temporarily transport students in unique situations on a short-term basis (i.e., twenty (20) or fewer work days). When such circumstances arise, the Superintendent will notify the Association President in writing, explaining the situation and the expected duration of the temporary transportation. If a situation is expected to last more than twenty (20) work days, the Superintendent will notify the Association so the parties can discuss the situation.

USE OF OUTSIDE TRANSPORTATION SERVICE. 1. The Board may utilize an outside service to transport (a) four (4) or fewer students with disabilities who are going in a single vehicle to an outside facility, or (b) students who are being transported because of homelessness or xxxxxx care placements. When such circumstances arise, the Superintendent will notify the Association President in writing, explaining the situation. If the “cap” concerning the number of students with disabilities on a single vehicle is exceeded, the District will have twelve (12) weeks to procure a vehicle to begin transporting the students with a District Bus Driver. If at the end of the twelve (12) week period, the District has been unable to hire a qualified Bus Driver despite exercising a good faith effort, the Transportation Supervisor will update the Association President and Superintendent that the vehicle has been procured but the District is continuing to work to employ a new Bus Driver. The Transportation Supervisor will update the Association President and Superintendent on a quarterly basis if the District continues to have difficulty employing a new Bus Driver. The District represents that it will act in good faith to attempt to use District drivers when feasible and financially responsible. The District’s analysis for a specific situation will be revisited prior to the start of each school year. Annually, the Transportation Supervisor will notify the Association President and the Superintendent of the number of students with disabilities that are being transported by an outside service pursuant to this Paragraph, along with the name and location of the outside facilities those students are attending. * The preceding Paragraph shall sunset at the conclusion of this Agreement and will prospectively read as follows as the starting place for any future negotiations: The Board may utilize an outside service to transport students in unique situations on a short-term basis (i.e., twenty (20) or fewer workdays).   • Transportation Services i) In the event that transportation services for a student served by CONTRACTOR pursuant to an Individual Services Agreement are to be provided by a party other than CONTRACTOR or the LEA or its transportation providers, such services shall be reflected in a separate agreement signed by the parties hereto, and provided to the LEA and SELPA Director by the CONTRACTOR. Except as provided below, CONTRACTOR shall compensate the transportation provider directly for such services, and shall charge the LEA for such services at the actual and reasonable rates billed by the transportation provider, plus a ten percent (.10) administrative fee, unless a “flat rate” is provided in the transportation contract. In the event that the transportation provider notifies the LEA or SELPA Director that CONTRACTOR is more than 90 days behind in payment for transportation services, LEA shall have the right, in its sole and exclusive discretion, but not the obligation, to make payment for such services directly to the transportation provider, and to deduct such payments from any sums owed to CONTRACTOR pursuant to this Master Contract and any Individual Services Agreement between the parties. In the event that the LEA makes direct payment of the transportation provider’s charges, it shall be entitled to withhold both the transportation charges themselves and such additional amount as shall be reasonably necessary to compensate the LEA for the staff and other costs incurred in making direct payment of those charges. The remedies provided to the LEA pursuant to this Paragraph shall not be exclusive. CONTRACTOR shall not include transportation through the use of services or equipment owned, leased or contracted through the LEA unless expressly provided in the Individual Services Agreement for the student transported.

  • TRANSPORTATION AND TRAVEL TIME 12.01 The Employer will provide transportation to and from jobs from the Employer’s shop. If an employee’s car is used for such transportation, the owner shall be paid fifty cents (50¢) per kilometre for such use.

  • Parking and Transportation ‌ The Union agrees that during the life of this Agreement, the University may apply changes in transportation policy, including adjusting parking and U-Pass fees and criteria for assigning parking spots, to the bargaining unit without the obligation to bargain with the Union. The Union may raise issues and concerns about the University’s parking program at Joint Labor/Management Committee meetings or at ad hoc Labor Management Committee meetings.   • DELIVERY TERMS AND TRANSPORTATION CHARGES Deliverables shall be shipped F.O.B. point of delivery unless otherwise specified in the Supplemental Terms and Conditions. Unless otherwise stated in the Offer, the Contractor’s price shall be deemed to include all delivery and transportation charges. The City shall have the right to designate what method of transportation shall be used to ship the deliverables. The place of delivery shall be that set forth the purchase order.
