Temporary Use of Non-Bargaining Unit Personnel. A Supervisor or Administration personnel may not perform the duties of a regular employee except for the purpose of instructing employees, or in extraordinary situations, or in assisting an employee with completing a task or duty which he or she is qualified to perform. It is further understood that bargaining unit work arising by operation of the Board's Building Use Policy will be assigned to the appropriate bargaining unit member(s) and compensated at the appropriate rate, meaning the overtime premium rate addressed in Article 18 of this Agreement in cases where Article 18 applies.

Temporary Use of Non-Bargaining Unit Personnel. For purposes of this provision, an emergency shall be defined as an unforeseen circumstance or a combination of circumstances which call for immediate action in a situation which is not expected to recur, or where a Bargaining Unit Employee has refused to perform work alleging unsafe or hazardous working conditions.
Temporary Use of Non-Bargaining Unit Personnel. The Employer agrees that supervisors or non-unit personnel shall not be used at any time to displace bargaining unit members regularly employed in the bargaining unit, except in emergencies when bargaining unit members are not available or have refused to do the work as assigned except in cases where unsafe conditions are being charged by a bargaining unit member.   • Transfer outside of the Bargaining Unit (a) A nurse who is transferred to a position outside of the bargaining unit for a period of not more than three (3) months, or is seconded to teach for an academic year shall not suffer any loss of seniority, service or benefits. A nurse who is transferred to a position outside of the bargaining unit for a period of more than three (3) months, but not more than one (1) year shall retain, but not accumulate, her or his seniority held at the time of the transfer. In the event the nurse is returned to a position in the bargaining unit, she or he shall be credited with seniority held at the time of transfer and resume accumulation from the date of her or his return to the bargaining unit.
