TCO. Borrower shall (a) maintain and keep in full force and effect (i) the permanent certificate of occupancy for the Improvements, or (ii) the temporary certificate of occupancy for the Improvements until receipt of the permanent certificate of occupancy, and (b) replace or renew any temporary certificate of occupancy for the Improvements that expires or otherwise terminates.
TCO. TELIGENT Central Office, which contains a digital telecommunications switch and related network management equipment that interfaces with TELIGENT Nodes and connecting networks and facilities.
TCO. The TCO shall be appointed by the Company and shall be the principal advisor to the GSC concerning the protection of controlled unclassified information and other proprietary technology and data subject to regulatory or contractual control by the U.S. Government. The TCO responsibilities shall include the establishment and administration of all intracompany procedures, including employee training programs to prevent the unauthorized disclosure or export of controlled unclassified information and to ensure that the Company otherwise complies with the requirements of the ITAR and EAR.
TCO. In consideration of the consummation of the Restructuring Transactions, from and after the Effective Date, TCO irrevocably shall be deemed to have released and forever discharged the Director and Geneva, and their respective employees, directors and officers (in their capacities as such) (each, for purposes of this clause (b), a "Released Person") of and from all contract claims, damages, losses, liabilities, obligations, actions and causes of action, whether presently known or unknown, which TCO may now have or claim to have against any Released Person pursuant to any of the Preferred Stock Agreements (other than claims for fraud against a Released Person). This agreement and covenant on the part of TCO (i) is contractual, and not a mere recital, and the parties hereto acknowledge and agree that no liability is admitted on the part of any party in connection with the Preferred Stock Agreements and (ii) shall inure to the benefit of and be enforceable by each Released Person.
