SOUND TRANSMISSION. Seller does not in any manner guarantee or warrant that the home will be soundproof or insulated to any particular degree from noise, sound or music emanating from within or without the Property, including, without limit, sound emanating from homes, heating, ventilation, air conditioning systems, plumbing, stereo systems, Common Area(s), or garages. Before executing this Agreement, Buyer should make his or her own investigation of the acoustic isolation of the Unit. Buyer has read and understands the foregoing Disclosure. Buyer acknowledges that Buyer's decision to purchase a residence in the Project is not based on any representation (other than as described in this Disclosure) regarding the matters described herein, and Buyer has considered the possible effect of such matters in Buyer's decision to purchase a residence in the Project.

SOUND TRANSMISSION. Buyer understands that the Unit is in close proximity to other dwelling units, in a multi-unit development in an urban environment; therefore, Seller makes no warranty or representation as to vertical or horizontal sound transmission that may arise from activities or building Systems in any unit, areas of the development or the neighborhood, or outside the Unit. Buyer realizes that where dwelling units are built above, below, or side by side each other, it is normal to experience transmission of sounds between those units from loud music; voices in the units or on decks, terraces, sidewalks, driveways, or adjacent streets; heels on uncarpeted floors; water traveling in drains; doors closing; and other causes. From time to time, noise from various building Systems may be heard from the Unit, including, but not limited to, noise from the heating and air conditioning equipment, plumbing, wind, contraction and expansion of window system, noise from overhead garage doors, fans in utility areas, air intake and exhaust, and/or mechanical equipment on the roof or in other areas.
SOUND TRANSMISSION. Each Owner, by acceptance of a deed or other conveyance of a Home, hereby acknowledges and agrees that sound transmission in Buildings containing attached homes is very difficult to control, and that the noises from adjoining and/or nearby Homes and/or mechanical equipment can often be heard in another Home. Declarant does not make any representation or warranty as to the level of sound transmission between and among Homes and the other portions of Xxxxxxx Square, and each Owner hereby waives and expressly releases any such warranty and claim for loss or damages resulting from sound transmission.
