Transmission of Business definition

Transmission of Business means where a business is transmitted from one employer or business owner to another.
Transmission of Business means the transfer of Employer obligations when the whole, or a part of a person’s business is transmitted to another person. Transmission of business rules can be found at Part 11 of the Act.
Transmission of Business means where a business, or part thereof, is sold or otherwise transmitted from ▇▇▇▇▇▇ & ▇▇▇▇▇▇ (or one of its subsidiaries) to another.

Examples of Transmission of Business in a sentence

  • Where a business is transmitted from one Employer to another, as set out in Clause 26, Transmission of Business, the period of continuous service that the employee had with the transmittor or any prior transmittor is deemed to be service with the transmittee and taken into account when calculating notice of termination.

  • In addition, redundancy payment does not apply in cases of Transmission of Business or where a suitable alternative role is identified for the Employee (whether accepted or not).

  • If the employer obtains acceptable alternative employment for the employee who has been made redundant (except in the case of Transmission of Business), the employee shall only be entitled to the redundancy payment for the period set out in clause 13.3, or for the period between the cessation of employment with the employer and the commencement of the alternative employment, which ever is the lesser.

  • In addition, redundancy does not occur in cases of Transmission of Business or where a suitable alternative role is identified for the employee (whether accepted or not).

  • This provision does not apply in circumstances involving Clause 13.8 Transmission of Business.

  • Redundancy and severance payments will not apply in the event of Transmission of Business.

  • Should the Council become the new employer in a Transmission of Business arrangement, the Council will undertake every reasonable attempt to ensure that the terms and conditions of employment, including current entitlements of transferring Employees to the Council are recognised and endeavour to provide suitable alternative employment.

  • Notwithstanding the provisions of the Rubber Workers (State) Award, "Transmission of Business" does not in itself create an entitlement to redundancy provisions of this agreement.

  • Transmission of Business The transfer, transmission, conveyance, assignment or succession, whether by agreement or by operation of law, of the whole or any part of the Company’s business, undertaking or establishment to which this Agreement applies.
