Off Duty Court. All employees required to appear off duty in any court as a witness for the prosecution or defense because of their official capacity as an employee of the City shall be paid at a rate of pay of time and one-half (1 ½) times the employees base rate of pay, for the time spent in court for a minimum of three (3) hours whenever a subpoena is submitted to and the overtime is approved by the City. All court compensation shall be returned to the City. This provision does not apply to civil actions unless the City is a litigant.
