Nonconforming Provisions. As noted above, the GSRP ISA contains provisions that do not conform to the ISA Form. First, Section 12.0 of the GSRP ISA states: The results of the System Impact Study require that, for the safety or reliability of the Transmission System, the Generation Interconnection Customer shall design its non-synchronous Customer Facility with the ability to maintain a power factor of at least 0.95 leading to 0.95 lagging measured at the Point of Interconnection. 8 The GSRP ISA also contains Appendices 1 and 2. Appendix 1 contains the definitions from section 1 of the Tariff. Appendix 2 contains the standard terms and conditions that are set forth in the ISA Form. The appendices attached to the GSRP ISA were compiled from a version of the Tariff in effect as of the ISA’s effective date. Xxxxxxxx X. Xxxx, Secretary August 25, 2020 The language is nonconforming, because section 12.0 does not contain provisions addressing the existing capacity at the Customer Facility. Although nonconforming, this power factor reflects the fact that power factor requirements were not specified for the GSRP Facility in the GSRP WMPA. The Commission has previously accepted use of nonconforming power requirements in such situations, and should do so again here.9 Additionally, in the Appendices and Schedules cover sheet, and in Schedule J, the name of the Schedule J Service “Schedule of Terms And Conditions for Surplus Interconnection Service” has been replaced with “[Reserved].” This is because this service is not currently offered under the Tariff. The use of this nonconforming language adds clarity, does not affect the rights or obligations of any Party to this agreement, and will not affect reliability. The Commission has accepted other ISAs with similar nonconforming provisions and should do the same here.10

Nonconforming Provisions. As noted above, the Remington ISA contains provisions that do not conform to the ISA Form. Specifically, Specifications section 2.1 states that the Interconnection Customer will have 170 MWs of Capacity Interconnection Rights, consisting of: (1) 152.3 MW the Interconnection Customer had at the same Point of Interconnection prior to its Interconnection Request associated with the Remington ISA; and (2) 17.7 MW associated with PJM Queue No. AE2-132 that will be available on an interim basis from the ISA’s effective date through May 31, 2022 (the “interim time period”) and on a non-interim basis thereafter. The availability and amount of any Interim Capacity Interconnection Rights awarded during the interim time period will be dependent upon the completion and results of an interim deliverability study. Interim Capacity Interconnection Rights awarded during the interim time period will terminate on May 31, 2022. These non-standard terms and conditions are necessary to clarify the conditions pursuant to which interim Capacity Interconnection Rights may be granted and are consistent with the interim Capacity Interconnection Rights language in Specifications section 2.1 of the ISA Form. The Commission previously has accepted for filing agreements with similar non-standard language,7 and should do so here.
