No Warranty of Success. Nothing contained in this Agreement shall be construed as a warranty on the part of either Party that (a) the Research Program will yield any Compound or will otherwise be successful, or (b) the outcome of the Research Program or the Development Program will be commercially exploitable in any respect.

Nothing contained in this Agreement shall be construed as a warranty, either express or implied, on the part of either Party that (a) the Development Program will yield a Product or otherwise be successful or meet its goals, time lines or budgets, or (b) the outcome of the Development Program will be commercially exploitable in any respect.

No Warranty of Success. Franchisor’s determination that Franchisee or Franchisee’s employee(s) have successfully completed any training shall not be a warranty or representation that the person can or will successfully operate the Licensed Business or any aspect thereof.

DUPONT DOES NOT WARRANT OR GUARANTEE THAT ANY SUCCESSFUL COMMERCIAL RESULTS WILL BE OBTAINED BY BIOAMBER AS A RESULT OF EXERCISING THE RIGHTS GRANTED PURSUANT TO THIS AGREEMENT. NEITHER DUPONT NOR ANY OF ITS AFFILIATES SHALL BE LIABLE TO BIOAMBER OR ANY OF BIOAMBER’S SUBLICENSEES BECAUSE OF ANY FAILURE IN BIOAMBER AND/OR ITS SUBLICENSEES OPERATIONS.

Nothing contained in this Agreement shall be construed as a warranty on the part of either Party that (a) the Research Program or any Additional Research Program will yield any Collaboration Compound or Candidate Drug or otherwise be successful, (b) any Development Program will yield a Product or otherwise be successful or (c) the outcome of the Research Program, any Additional Research Program or any Development Program will be commercially exploitable in any respect. In addition, nothing contained in this Agreement shall be construed as a warranty on the part of Targacept that it will provide any Option Compounds or ROFN Indication Opportunities to AstraZeneca.
No Warranty of Success. Nothing contained in this Agreement shall be construed as a warranty on the part of either Party that (a) the Research Program will yield any Collaboration Aptamer or otherwise be successful, (b) any Development Program will yield a CONFIDENTIAL Portions of this Exhibit were omitted and have been filed separately with the Secretary of the Commission pursuant to the Company’s application requesting confidential treatment under Rule 406 of the Securities Act. 115 Product or otherwise be successful or (c) the outcome of the Research Program or any Development Program will be commercially exploitable in any respect.
No Warranty of Success. CHIRON MAKES NO WARRANTIES OR GUARANTEES OF ANY KIND THAT THE RESEARCH AND DEVELOPMENT ACTIVITIES FUNDED HEREUNDER WILL BE SUCCESSFUL OR WILL ACTUALLY RESULT IN ANY MARKETED PRODUCTS.
No Warranty of Success. While the parties agree to use reasonable ---------------------- efforts to achieve the goals of the Development Program and this Agreement, neither Celtrix nor Genzyme warrants or guarantees that the goals specified in any Work Plan will be achieved within the time and financial parameters set forth therein, that their efforts will result in an approvable Product or that if approved, that any Product developed hereunder will be successful in the marketplace.
