No Warranty of Success. Nothing contained in this Agreement shall be construed as a warranty, either express or implied, on the part of either Party that (a) the Development or Commercialization of any Licensed Product or any Licensed Product will be successful, or (b) any Licensed Product will be commercially exploitable in any respect.
