Most Favored Customer Pricing. The prices under this Agreement shall be at least as low as the prices under any other contract instrument under like terms and conditions. If at any time the prices under any other contract instrument become lower than the prices in this Agreement, this Agreement shall be modified to include the lower prices.

Most Favored Customer Pricing. The Company shall offer on the Co-Branded Site and the Company Site to Users from the Snap Sites the Company's most favored customer pricing, which means pricing and terms substantially similar to the lowest pricing and most favorable terms offered by the Company to any other Users of the Company Site. The Company shall maintain competitive pricing for the products and services it offers.
Most Favored Customer Pricing. In the event that Materia supplies Catalysts to any Third Party, for use in the Field, at prices lower than those offered for such Catalysts to Renegade under the Commercial Supply Agreement for comparable purchase volumes, during comparable time periods and at comparable specifications, Materia will promptly notify Renegade in writing of such lower pricing, and the Commercial Supply Agreement shall be deemed to be amended effective immediately as of the date of such lower Catalyst pricing, and Materia shall adjust all prices to such lower prices for all future Renegade orders and all outstanding orders not yet shipped. Most Favored Customer Pricing. 14.1 During the Term, VENDOR guarantees to Northwest that the Services Rate (defined herein as the aggregate sum of the pricing of the EHR, Transportation Rate, and time and material rates set forth in Attachment C ) actually paid by Northwest under this Agreement shall be more favorable than or at least as favorable as the pricing of an EHR, Transportation Rate and time and material rates paid by any other VENDOR customer (the “Other Customer”) in any other agreement entered into by VENDOR with the Other Customer for the sale of CF34-3B1 Services described herein under comparable terms and conditions (including, without limitation, engine model, fleet size, term length and fleet operating parameters). If VENDOR enters into an agreement with the Other Customer with an EHR, Transportation Rate or time and material rates that are more favorable than the rates paid by Northwest under this Agreement, subject to the conditions above, then Northwest shall have the benefit of the Other Customer’s pricing from the effective date of the Other Customer’s agreement. In such event, VENDOR shall notify Northwest and reconciliation shall be performed, as required. VENDOR will not be required to offer the Other Customer pricing to Northwest if that pricing is part of a material equity partnership or joint venture.
Most Favored Customer Pricing. The prices that MGEN shall charge FNIS with respect to any Services rendered or to be rendered hereunder, or under any Project Scope Document, shall be no higher than those offered to any direct competitor of FNIS for substantially similar Services. In the event MGEN is in breach of the foregoing, such lower prices shall apply to FNIS effective as of the date such lower rate were first offered to such other customer, and appropriate adjustments shall thereafter be reflected on all appropriate Project invoices.

Most Favored Customer Pricing. JAWS warrants that it has not, directly or indirectly, entered into any agreement relating to the Products and Services which provides pricing terms which are more favorable than the pricing terms specified in this Agreement. If JAWS has entered into any such agreement, or in the future enters into any such agreement, which contains pricing terms which are more favorable than the pricing terms specified in this Agreement, then JAWS will immediately notify Axion and extend the same pricing terms to Axion.
Most Favored Customer Pricing. Contractor agrees that in the event that, prior to the delivery of any particular item of Material, it offers or charges prices to any other customer for such or any substantially similar item of material that are less than the prices charged to Exelon under this Agreement (in each case, after taking into consideration all discounts, allowances, rebates and other types of price and fee reduction mechanisms), the prices charged under this Agreement for such item of Material shall be deemed automatically revised to equal such lower prices and, in the event that Exelon shall be entitled to such lower prices but shall have made payment at any prices in excess thereof, Contractor shall promptly refund the difference in price to Exelon. Each invoice submitted by Contractor under this Agreement shall indicate the lowest price charged by Contractor to any other customer that purchases the same or any substantially similar item of material within the 90 day period immediately preceding the date of the invoice.
