SIMILAR SERVICES. Any provisions limiting the Agency's right to obtain similar services or equipment in the event of default or non-funding during the term of the agreement are hereby deleted.
SIMILAR SERVICES. Nothing in this Contract shall prevent the Contractor from performing similar services for other parties. However, the Contractor warrants that at no time will the compensation paid by the Department for services rendered under this Contract exceed the rate the Contractor charges for the rendering of a similar benefit package of services to others in the Contracting Area. The Contractor also warrants that the services it provides to its Enrollees will be as accessible to them (in terms of timeliness, amount, duration and scope) as those services are to nonenrolled Participants within the Contracting Area.
SIMILAR SERVICES. It is expressly understood and agreed that nothing herein shall be construed to prevent, prohibit or restrict the Manager or any Affiliate of the Manager from providing the same or similar services as those provided under this Agreement to any other Person or from manufacturing, selling, owning, providing contract compression services, managing, maintaining, operating or otherwise dealing with Compressors on its or others’ behalf; provided that no such activity shall in any way reduce the obligations of the Manager hereunder to comply with the Services Standard.

It is expressly understood and agreed that nothing herein shall be construed to prevent, prohibit or restrict Manager or any Affiliate of Manager from providing the same or similar services as those provided under this Agreement to any other Person or from manufacturing, selling, owning, leasing, managing or otherwise dealing in other railcars; provided that no such activity shall in any way diminish the obligations of Manager hereunder.

SIMILAR SERVICES. Customer acknowledges that iGrafx provides similar services and Deliverables to other clients and that nothing in this Agreement shall be construed to prevent iGrafx from carrying on such business. In the event that Deliverables contain Customer’s Proprietary Information, iGrafx has the right to retain and use internally copies of such Deliverables, provided, however, that the foregoing does not include rights to distribute, disclose or create derivative works from Customer’s Proprietary Information that is incorporated into the Deliverables. Customer acknowledges that the Software, Deliverables, and Documentation are not a “work made for hire” and Customer shall not sell, transfer, publish, disclose, display or otherwise make available the iGrafx Information. Notwithstanding any provision in this Agreement to the contrary, Customer shall acquire no right to any software under this Agreement.

SIMILAR SERVICES. Customer acknowledges that EPL IT is free to offer services or work product similar to the Services or Reports to other EPL IT customers or third parties without restriction or royalty to Customer.
SIMILAR SERVICES. Subject to the restrictions in this Section, ---------------- Section 3 and Section 4.4 of this Agreement, and Altiris' compliance with the confidentiality provisions stated herein, nothing in this Agreement shall restrict or limit Altiris from performing the same or similar services for, or providing the same or similar products to, any other entity in any industry, including the computer, software, semiconductor and electronics industries. Compaq agrees that, except as otherwise provided for in this Agreement, Altiris and its employees may provide services similar in nature to the services under this Agreement for any third parties both during and after the term of this Agreement.
