Management Discretion a) Any decision affecting any matter not herein expressly provided for shall rest solely within the discretion of DPAC’s General Manager or their designee.
Management Discretion. LICENSEE and PACA agree that any decision affecting any matter not herein expressly provided for shall be made within the sole discretion of PACA’s President/Chief Executive Officer or PACA's management’s staff.

Management has the discretion in deciding whether a particular position or class of positions is appropriate for the Telework Program based on the content of the work, consistent with the criteria set forth in this Article. Management will also consider the performance of the participant in determining eligibility for initial and continued participation in the program. Management reserves the right to alter the participant’s established telework schedules to accommodate work demands or for any other official purpose. (Changes to work schedules are covered by Article 6, Hours of Work, and will be made in accordance with the provisions of that article.)
Management Discretion. Telework is subject to approval by management and is not an employee entitlement. Approval or denial of an employee’s request to telework will be based on telework not diminishing the employee’s performance or agen- cy operations, applicable law, regulation, and the provisions of this Article. Management has the discretion in deciding whether a particular position or class of positions is appropriate for the Telework Program based on the content of the work, consistent with the criteria set forth in this Article. Although an employee may request a particular day(s) and/or time to telework, NRC management has final approval.
Management Discretion if none of the above circumstances in Clause 3.2.12 apply and you are affected by other unforeseen extenuating circumstances we may (at our discretion and on an individual basis) consider a request by you to cancel your Contract. Any such request must be made to the manager directly in writing or email.

The intention is for management discretion to be considered for Pay anomaly (See below) Where an individual has key or scarce skills Where an additional increase is required over and above the pay calculations due to significant/outstanding contribution. Those who are adrift from their MRS Pay Anomaly Pay planning managers should still be alert to pay anomalies which are defined as: Individuals whose salary has not been increased for a number of years. Where an individual’s salary has not been increased for a number of years a check should be made to ensure that the salary is at the level appropriate to the individual’s current contribution and value. A pay anomaly can be defined as those who are below the median and performing well (A, E or O) in the same role for at least three years, or very well (E or O) for at least two years.
Management Discretion. Tenant members may be asked to leave The Room at Management’s discretion, with or without cause. I confirm that I have carefully read Article I and Article II above and agree that I will be subject to all policies and rules and regulations of The Room now in force or adopted in the future, including, but not limited to, those governing use of The Room facilities, the equipment therein and the dress code. I agree not to create any nuisance or disturbance or harass or threaten other users, guests or The Room personnel or commit acts of moral turpitude or fraud while using The Room facilities. I understand that breach of any policy or rule or regulation may result in the revocation of my rights to use The Room. I acknowledge that The Room, in its sole discretion, reserves the right at any time to alter the hours of operation, and the right to amend the cost of, add, modify and/or eliminate any program, facility, equipment, activity, class or service of The Room.
