Management Discretion a) Any decision affecting any matter not herein expressly provided for shall rest solely within the discretion of DPAC’s General Manager or their designee.

An employee who has received an Outstanding or an Exceeds PAC rating for the past two years and has not received a Rise+ increase. The activity being undertaken as part of the “Pay and Progression” element of this Agreement is also designed to help address this type of anomaly.
Management Discretion. Without limiting the foregoing, and subject to the oversight of the Board's control and direction, the senior officers of PGM shall have the authority to retain all current PGM employees in their present positions, subject to their annual review, provided that nothing herein shall be deemed to cause such employees to be deemed third-party beneficiaries of this Agreement. 5.

Approval or denial of an employee’s request to telework will be based on applicable law, regulation, and the provisions of this Article. Management has the discretion in deciding whether a particular position or class of positions is appropriate for the Telework Program based on the content of the work, consistent with the criteria set forth in this Article. Although an employee may request a particular day(s) and/or time to telework, NRC management has final approval.

Management Discretion if none of the above circumstances in Clause 3.2.12 apply and you are affected by other unforeseen extenuating circumstances we may (at our discretion and on an individual basis) consider a request by you to cancel your Contract.
