Lease to Remain in Effect. If Landlord or Tenant does not terminate this Lease as hereinabove provided, this Lease shall continue in full force and effect, except that rental and Tenant's Operating Cost Share shall abatx xx the extent Tenant's use of the Premises is impaired for any period that any portion of the Premises is unusable or inaccessible because of a Casualty or Taking hereinabove described. Each party waives the provisions of Code of Civil Procedure Section 1265.130, allowing either party to petition the Superior Court to terminate this Lease in the event of a partial condemnation of the Premises.

Lease to Remain in Effect. Notwithstanding Landlord's right to terminate this Lease, Landlord may, at its option, even though Tenant has breached this Lease and abandoned the Premises, continue this Lease in full force and effect and not terminate Tenant's right to possession, and enforce all of Landlord's rights and remedies under this Lease. Lease to Remain in Effect. If such damage or destruction as described in 12.1 and 12.2 above occurs and this Lease is not so terminated by the Lessor, this Lease shall remain in full force and effect. Lessee shall in the event of any such damage or destruction, unless the Lease shall be terminated as provided in 12.2, forthwith replace or fully repair all exterior signs, trade fixtures, equipment display cases and other installations originally installed by Lessee.
