Any notice. (a) given by us to you will be deemed received and properly served 24 hours after it is first posted on our website, 24 hours after an email is sent, or three days after the date of posting of any letter; and
(b) given by you to us will be deemed received and properly served 24 hours after an email is sent, or three days after the date of posting of any letter.
Any notice. 18.3.1 addressed to the recipient in the manner prescribed by this Agreement shall, if sent by internationally recognized express mail courier service, be deemed to have been served or delivered on the day it was so delivered;
18.3.2 not sent by internationally recognized express mail courier service, but delivered by hand to or left at an address in accordance with this Agreement, shall be deemed to have been served or delivered on the day it was so delivered or left;
18.3.3 sent by fax transmission shall be deemed to have been served or delivered at the time it was sent, and in proving such service it shall be sufficient to produce a transaction report or log generated by a fax machine which evidences the fax transmission on an error-free basis;
18.3.4 sent by email shall be deemed to have been served or delivered at the time it was sent, and in proving such service it shall be sufficient to produce a copy of such email reflecting the date and time of transmission and confirmation of receipt.
Any notice. 7.2.1 if to be given to the Authority shall be sent to: [Address] Attention: [Contact name and/or position, e.g. “The Finance Director”]
7.2.2 if to be given to the Organisation shall be sent to: [Name of Organisation] [Address] Attention: [ ]
8.1 This Agreement shall be governed by, and construed in accordance with, English law and any matter claim or dispute arising out of or in connection with this Agreement whether contractual or non-contractual, shall be governed by and determined in accordance with English law.
8.2 Each Party hereby irrevocably submits to the exclusive jurisdiction of the English courts in respect of any claim or dispute arising out of or in connection with this Agreement.
Any notice. (i) if mailed and properly addressed with postage prepaid or if properly addressed and sent by pre-paid courier service, shall be deemed given when received;
(ii) if transmitted by facsimile, shall be deemed given when transmitted provided it is received in legible form; and
(iii) subject to paragraph (c) below, if transmitted by electronic mail, shall be deemed given upon acknowledgment of receipt by the recipient in readable form (it being agreed that any electronic mail so acknowledged after 5:00 p.m. in the location of receipt shall be deemed to have been given on the following day).
Any notice. 20.4.1 delivered by hand to a responsible person during ordinary business hours at his Chosen Address, shall be deemed to have been received on the day of delivery;
20.4.2 if sent by prepaid registered post from within South Africa, be deemed to have been received within 5 (five) days of posting, unless the contrary can be proven;
20.4.3 sent by email to his Chosen Address, shall be deemed to have been received on the date of dispatch and at the time recorded by the computer/device used by the sender of the email (unless the contrary is proven).
Any notice. 9.13.1 (a) must be in writing and must be given:
(i) to a company which is a party at its registered office or to such other address as may have been notified to the other party; and
(ii) to any individual who is a party at the address of that individual given at the beginning of this Agreement; and
Any notice to the Buyer under the provisions of this Agreement shall be valid and effective if delivered personally, by courier or by facsimile transmission to or, if given by registered mail, postage prepaid, addressed to the Buyer at its principal office at *[REDACTED], and shall be deemed to have been given on the date of delivery personally or by facsimile transmission if so delivered prior to 5:00 p.m. (Toronto time) on a Business Day and otherwise on the next Business Day or on the third Business Day after such letter has been mailed, as the case may be. The Buyer may from time to time notify the Seller of a change in address which thereafter, until changed by further notice, shall be the address of the Buyer for all purposes of this Agreement.
Any notice. (a) required to be given by a party may be given by that party's solicitor or agent and/or
(b) addressed to a party by name is not rendered invalid by reason of the party having died, become insolvent or changed name, whether or not the party serving notice is aware of the fact.
Any notice to the Buyer under the provisions of this Agreement shall be valid and effective if delivered personally, by courier or by facsimile transmission to or, if given by registered mail, postage prepaid, addressed to the Buyer at its principal office at Fxxxx Xxxxx, X.X. Xxx 000, Xxxx Xxxx, Xxxxxxx, XX0000, Xxxxxxx Virgin Islands, Fax: (000) 000-0000/7422, Attention: Pxxxx Xxxxx, and shall be deemed to have been given on the date of delivery personally or by facsimile transmission if so delivered prior to 5:00 p.m. (Toronto time) on a Business Day and otherwise on the next Business Day or on the third Business Day after such letter has been mailed, as the case may be. The Buyer may from time to time notify the Seller of a change in address which thereafter, until changed by further notice, shall be the address of the Buyer for all purposes of this Agreement.
