Group B persons age 18 and over who are not in Group A, meet the non-financial requirements to receive home and community-based waiver services and have a gross monthly income no greater than a special income limit equal to 300% of the SSI federal benefit rate for an individual.
Group B. Cement Masons who have been employed by an Employer or Employers party or parties to this Agreement who have worked for such Employer or Employers for an aggregate time of less than seven hundred and fifty (750) hours during the period of one (1) year immediately preceding registration date, or journeyman Cement Masons when they can show proof of three (3) years within the immediate previous five (5) years experience in building and construction of cement finishing work. Each applicant for employment shall be required to furnish such date, records, names of Employers and length of employment licenses as may be deemed necessary, and each applicant shall complete such forms or registration as may be submitted to them. An applicant for employment shall also list any special skills they may possess.
Group B. The regular hours of work for employees listed in this group shall be eight (8) hours per day and forty (40) hours per week for thirty-one (31) consecutive weeks of the year (during “peak season”) and seven (7) hours per day and thirty-five (35) hours per week for twenty-one (21) weeks of the year (during “off season”) with the exceptions as provided for in Letter of Understanding #5-Extra Hours of Work. The “Normal Peak Season” is from April 1 to October 31, with the exception of Luther Marsh where the “Normal Peak Season” is from May 1 to November 30. The Employer will maintain its current practice regarding lunch periods for employees in this group.
Group B. Site work employee: A site work employee is an employee who by reason of his employment is normally required to live away from his usual place of residence. For purposes of this clause the place where the employee first presents himself for employment shall be regarded as his usual place of residence.
Group B. Class Members who submitted a complaint about the Power Defect and/or Overheating Issue prior to March 19, 2019 to Defendants’ customer service department and for whom Defendants possess contact information shall automatically receive a$210 Credit Certificate, without the necessity of filing a Claim. If such a Class Member prefers a $110 Cash Payment instead of a $210 Credit Certificate, then they must submit a Group B Valid Claim. A Claimant who submits a Group B Valid Claim shall receive a $110 Cash Payment. In order to submit a Group B Valid Claim, the Claimant must comply with the requirements in Section 6.6.
