Future Encumbrance. Landlord shall have the right to cause this Lease to become, be and remain subject and subordinate to any and all Mortgages that may hereafter be executed covering the Project, the Building, the Premises, or the real property thereunder or any portion thereof, for the full amount of all advances made or to be made thereunder and without regard to the time or character of such advance, together with interest thereon and subject to all the terms and provisions thereof; and Tenant agrees, within ten (10) days after Xxxxxxxx’s written request therefore, to execute, acknowledge and deliver upon request any and all documents or instruments requested by Landlord or necessary or proper to assure the subordination of this Lease to any such Mortgages. Xxxxxx’s failure to execute any such documents contemplated by this Article 22.2, including the Nondisturbance Agreement, shall constitute a material breach of this Lease.
