Shopping Center. Exhibit A sets forth the site plan of the Shopping Center which has been constructed ("Site Plan"). Tenant acknowledges that the Site Plan shall not be deemed a representation by Landlord that the Shopping Center shall be constructed as indicated thereon or that any tenants or occupants designated by name or nature of business thereon shall conduct business in the Shopping Center during the Term; and, provided that Tenant’s use and enjoyment of the Premises is not materially affected, Landlord may, in its sole discretion, increase, decrease, or change the number, locations, and dimensions of the buildings, driving lanes, driveways, walkways, parking spaces and other improvements shown on the Site Plan (excluding the Premises), and Landlord reserves the right to construct new buildings and/or make additions and alterations to all buildings constructed in the Shopping Center.

Shopping Center. The Shopping Center will be developed, owned, and operated as Springfield Commons, a mixed-use development consisting of a Marriott Towne Place Suites hotel, and anticipated to include a gasoline/convenience store, one (1) or two (2) outparcels, and numerous retail stores and restaurants totaling approximately 150,000 SF. The retail stores will be comprised of two (2) to three (3) buildings between 20,000 SF and 120,000 SF each. The retail/restaurant tenants within the Springfield Shoppes will operate under net lease agreements whereby the tenant is metered separately for utilities, will have its own HVAC and mechanical systems and pay for utilities, janitorial, and waste removal. Any costs and expenses paid directly by the Tenants within leasehold premises are not included as CAM expenses.

Landlord and Tenant acknowledge that as of the Effective Date the Shopping Center has not been constituted as a separate legal parcel by the recordation of a final subdivision map. The City of San Xxxxx has approved subdivision map number 69-49 dated May 1988 that is consistent with Exhibits A and B-1. Landlord shall cause all conditions to the recordation of such approved subdivision map to be satisfied and cause it to be recorded so that the Shopping Center is constituted as a separate legal parcel. Landlord shall not allow any changes to be made to such subdivision map without the prior written consent of Tenant.

Shopping Center. Landlord is the owner of a parcel of real estate, legally described on Exhibit C, located in 0000 Xxxx Xxxxxx, Xxxxxxx Xxxxxx, Xxxxxxx commonly known as the FB Main Street – a Master Condominium (the “Shopping Center”). It is agreed that the depiction of the Shopping Center on Exhibit A does not constitute a representation, covenant or warranty of any kind by Landlord. Landlord reserves the right to sell any portion or portions of the Shopping Center, such portion(s) thereafter shall not be included in the Shopping Center. Landlord reserves the right to change the number and location of buildings, building dimensions, the number of floors in any of the buildings, store dimensions, the identity and type of other stores and tenancies, and Landlord further reserves the right to locate kiosks and to make available common areas pursuant to the terms hereof, provided only that the Leased Premises as hereinafter defined shall be substantially as depicted on Exhibit A. Landlord further reserves the right to alter the Shopping Center, at Landlord’s sole election, however, no such alteration shall materially impair the visibility or accessibility of Tenants Leased Premises.
