Failure to Conduct Annual Review. Failure of City to conduct an annual review shall not constitute a waiver by the City of its rights to otherwise enforce the provisions of this Agreement nor shall Developer have or assert any defense to such enforcement by reason of any such failure to conduct an annual review.

Failure to Conduct Annual Review. The failure of the City to conduct an annual monitoring review shall not be a Default by Xxxxxxxxx’x, provided Xxxxxxxxx’x initiates the annual monitoring review with a timely submittal of documents pursuant to Section 7.2.1.

Developer acknowledges that this Annual Review Fee may be increased by City Council’s adoption of a subsequent resolution.
Failure to Conduct Annual Review. City’s failure to conduct the annual review shall not be an Owner default. Further, Owner shall not be entitled to any remedy for City’s failure to conduct the annual review.
