Environmental Incidents an Environmental Incident occurs which gives rise, or may give rise, to an Environmental Claim which could, in the opinion of the Agent be expected to have a material adverse effect (i) on the business, assets or financial condition of any Security Party or the Group taken as a whole or (ii) on the security constituted by any of the Security Documents or the enforceability of that security in accordance with its terms; or

Environmental Incidents. Each Debtor shall take, or cause to be taken, such actions as may be reasonably required to mitigate potential liability to it arising out of Environmental Incidents or as may be reasonably required to protect the interests of the Agent and the Lenders with respect thereto.

Environmental Incidents. 12.2.1. Without limiting the Owner's obligations under Clause 14 or under Environmental Laws, the Owner shall immediately and no later than one hour after becoming aware of any Pollution Incident give written notice to Melbourne VTS of the occurrence of such a Pollution Incident.

Promptly upon any report made pursuant to Section 8.1(v), the Oversight Committee shall cause an assessment of the events made the basis of the report and determine any required remedial operations. Contractor shall perform the remedial operations at its sole expense; provided, if during remediation operations contaminants foreign to the spill, release or other incident causing the assessment and remediation are identified, remediation in respect of such foreign contaminants shall be performed by Contractor unless Customer elects otherwise, and expenses and liabilities associated therewith shall be allocated (i) between Contractor and Customer in accordance with any applicable baseline previously determined in accordance with Section 9.1, or (ii) if no such baseline exists for the particular Scheduled Location, to Customer. Other than with respect to foreign contaminants for which Customer is allocated expenses and liability pursuant to the foregoing, should Customer incur any directives, fines, penalties or other charges or expenses of any kind whatsoever as a result of any environmental incident, Contractor shall pay all such amounts, or reimburse Customer if Customer has paid same.

All environmental incidents such as pollution (air, water, land, noise, etc.), bird kills, and animals killed, plants destroyed, public complaints etc. shall be reported to project leader and / or environmental advisor within 24 hours of its occurrence. • All environmental incidents occurring on site shall be recorded according to Eskom Procedure detailing how each incident was dealt with. Proof thereof must be kept in an incident register. • The Contractor shall be held liable for any infringement of statutory requirements of the Environmental relevant legislation.
